Thursday 7:30 am- My family is ripped apart. Like I stated in a previous post, we are now one of those families you read about. David is followed and picked up by ICE (immigration). He did not commit a crime. We believe it was either our application for his legal status that instigated it, or someone being cruel and reporting him. After 10+ yrs of never having an issue... Living in the same house... We have been attempting to get him legal status FOR YEARS. (He originally came to the US on a temp Visa touring with a band he played in... ). After being taken for thousands of dollars from so-called attorneys years ago, we gave up for awhile. Lived our lives. Soccer/Baseball/wrestling parents... Working towards a better life, living by the law, with morals and values. We have 6 children and another on the way, it being a high risk pregnancy. 3 oldest are his step children, but they call him dad just the same. He raised them as his own. We have a beautiful autistic daughter whom he is very involved with when it came to therapies. She was lost in her own world- wouldnt speak or acknowledge you were there... But our patience, and persistence has paid off, to a higher functioning 1st grader... He is a gifted musician who has given back to the community by playing for free for community events, and has played many a benefit dance. -We went to another attorney last year and she told us the only way for David to fix his papers would be if he was in Mexico and I petitioned for him. We had no other hope. Same story we had heard in the past- no hope. I went to see yet another attorney- stating we wanted to petition for David- I put it in as if David was in Mexico- knowing he would need to leave for the process. This was mid this year. We were waiting for the holidays to be over since he is my financial support due to my having a medical layoff from my job, (tumor removed in December of last year from my uterus), with the state of Idaho. I am currently waiting for a call back. Next thing you know David is detained. He was torn out of our lives - after numerous attempts of doing it the right way and failing. We tried it the only way we were told it was possible. It is a broken system. It is expensive, difficult, and extremely confusing. We took a risk, but havent all of us in our lives at one point or another to make a better life for ourselves, our children, our loved ones? Judge us only if you have NEVER done anything you KNEW was wrong for the sake of the better good. There is a lot of controversy, and prejudice out there, especially now with the Obama order... But honestly something drastic had to happen in an attempt to fix something so screwed up. I like to think I am an intelligent person... I take responsibility in the fact that regardless his status was illegal, but we attempted to right the wrong numerous times, to no avail. * David has always worked- interviewed, submitted resumes, and acquired jobs through his experience and expertise. He was chosen as the better candidate. He never TOOK a job from anyone. He works hard to provide. He loves this nation that has become his home. He even, (at one point), looked to see if there was a possibility of him joining the military. And as a married couple weve had our ups and downs, but then again, who hasnt? We are now fighting for David - we have put in something called a Stay of Removal- and immigration is fighting us tooth & nail. They want him out- even though he meets the criteria- why? Because it is in their power. They want to deny without looking at the petition because it wasnt submitted with a passport. They have his drivers license, his fingerprints, his birth cert, and they want a passport. They wont release him so he can get one, the consulate will only give him one if he goes in person- so its an impossible situation. How do you work with that? Its a setup for failure. This is one of many catch 22s in the immigration system. Hell, I dont even have a passport. They will cause this family to have to rely on the system for support just because of a broken immigration system. If you have never lived it, attempted to get legal status the right way and you have a negative opinion about this, I ask that you keep those comments to yourself. Everyone is entitled to their opinions and I respect that. But if you have never gone through this ridiculous, dead end, inconsistent maze of immigration, you really dont know... I literally cry with frustration. With disbelief. With complete disgust and pain. I dont sleep & cant eat. My kids ask me if they will have their daddy with them ever again. We are hurting. We are trying to fix it and we cant. Our attorneys are doing everything in their power and it is not good enough. My children cannot grasp the concept of daddy being in jail, detained, if he didnt steal, didnt hurt anyone, but just because he was born in Mexico and came here, has been with mommy and is working towards supporting his family - for a better life?!? * David speaks perfect English. Never looking for a handout. We received several letters to present to immigration from people who know and love David. From his employer, co-workers, friends and family... I gave our attorney everything we had- and maxed out my credit card and it still wasnt enough to cover the expense. But thankfully they are not in it solely for the money- they have been on it NONSTOP since the moment David was detained. I was texting/emailing info up until 8--9 pm tonight. I am asking to please find it in your hearts to pray for our situation. For resolution. That is all I ask. For the sake of our friendship...
