Tier I, II, or III? It makes a difference whether its a defendants first, second, or third #DUI charge, but it makes a major difference with respect to a prospective jail sentence if a defendant is classified as a repeat offender for sentencing purposes. For example, in #Pennsylvania, a defendant facing a third DUI charge is potentially subject to a mandatory minimum 10 day jail sentence if classified as Tier I. That same defendant is potentially subject to a mandatory minimum 1 year jail sentence if classified as Tier III.
