To Sri.Bhanwar lal The Chief Electoral Officer, Andhra Pradesh. Sub: Malpractice and misconduct in violation of the election code, closing of wines shops during election month Req.Reg., Respected Sir, I am P.Mohan chary, an Engineer and a resident of Andhra Pradesh. I felt a deep sense of grievance against the ongoing election canvassing procedure by our politicians in the state and I would like to express my concern over the malpractice and misconduct in violation of the election code which we hear frequently in the news. Ours is the largest democracy in the world, where our representatives upholds the dignity of constitution with stable government along with good governance. But today I feel embarrassed to hear the news of violation of election code where our politicians use all possible unfair methods to seek votes from their constituency people through which they are crossing the official limits of the expenditure margin imposed by the election commission . Politicians are directly encouraging the supply of wine, Liquor etc along with huge flow of money and other such gifts to mould the voters opinion and influence their choice of voting . The contestants from village to Lok Sabha every are adopting the same procedure. The above incidents reveal that our protectors & rulers of democracy themselves are making our democracy weak in their greedy attempt to capture the power. Free and fair elections are declared as basic features of our great Constitution. It is expected that the voters are not influenced unduly by inducement of money, gifts, and liquor. While so the present scenario of the State of Andhra Pradesh appears to be quite contrasting. Apart from making impracticable and lofty promises, the political parties are also trying to lure the voters on the basis of region and caste .The most dangerous aspect is the undue and illegitimate expectation the political parties have created among the voters as to the purchase of votes and free supply of liquor. If a voter is asking for a bottle of liquor or “Pavva” whenever a leader like person is trying to talk to him, this phenomenon would be the downfall of democracy in India. Whether it is the offer of liquor or demand for the same, it is possible only when there is availability of liquor.It may be recalled that Article 47 of the Constitution directs the State to impose prohibition on trading and consumption of intoxicating liquors. Even if such total prohibition is not possible due to revenue purposes, at least partial prohibition may be imposed during the election period. I am advised that even the courts would uphold any policy of the government or decision of the EC if trading and consumption of liquor is prohibited during the election period ,for instance during one month before the voting, during the days of voting and for one or two weeks after conclusion of voting. Sir, as a responsible citizen I request you to kindly close the Wine& Belt shops in our state during this election month as a part of election code. While Comparing the Statistical data for the months of December2013 and January 2014 with regard to the excise department income with February, March 2014 income, the later income would show a drastic increase. So, please consider our request to conduct the free & fair elections and better change of the India and ensure Good Governance of the state.
