Todays The Mechanicsville Local includes a fornt-page story about the pending vote on the movie theater. In it they quote Mr. Peterson who stated, Personal property rights are one of the cornerstones that our country was built on... Simply saying we dont want it is not sufficient reason to violate those rights. It is interesting to us that the Hanover County, Virginia Board of Supervisors seems to be deaf to the arguments we have been making. When it comes to land rights, the Boards role is not just protecting the land rights of the developer. The very purpose of the Conditional Use Permit is to balance the rights of the developer and the existing land owners -- to protect the land rights of the existing property owners. The Board has been touting the Conditional Use Permit as a reason to approve this plan because it will give the County control over what is built on the property. The problem is that the Conditional Use Permit is very weak. The Board is not leveraging the power they have to protect the other land owners. That is obvious when comparing the theater permits to the permit for this theater. There may be no legal reason that the movie theater cannot be built. However, the Hanover Board of Supervisors will be violating the property rights of the existing property owners if they do not strengthen the Conditional Use Permit and insure due diligence when it comes to the traffic study.
