Triplicate (Transcript) Gabbi Kumera Declaration at Ernabella Notice to the Crown, It’s Government & Agencies in respect of the Sovereign Tribes and Territories of the Original Tribal People of the land. As at Monday 25th April 2011 at Ernabella we have met with the intention of also meeting at other communities, such as Alice Springs, on Tuesday 26th & Wednesday 27th April 2011. Those sovereign tribes presenting at the meeting for the Gabbi Kumera Declaration representing the tribes of Cape York, and North Queensland and the Western Desert System, etc. All of our Original Sovereign Tribal People owners and fellow esteemed lawmen and women, Elders, and others of sufficient rank which have a direct bloodline connection to their birthright Country and have Treaty in place with each other have agreed to voice their intentions, concerns and demands through the tribal council with the purpose of protecting Original Sovereign Tribal people, Tribal lands and ancestral entitlements. The Member Tribes of Tribal Council are fully aware of the fact that the Crown not only never had any lawful claim over title to this island continent – we are also aware that the Crowns own High Court has denied the Crown the status is claimed over OUR lands as made in respect of the Crowns claim of title via the application of the process of Terra Nullius. We are aware that the Crown’s claim of Terra Nullius was denied by its’ own High Court that the Crown has no other claim to either Sovereignty or dominion over our Sovereign Lands nor people nor natural and other wealth. The National Congress of Australia’s First peoples does not speak for nor on behalf of, nor does it represent the Member Tribes of the Tribal Council. 2. The Member Tribes of the Tribal Council hold Sovereign Lodial title over and its’ agents and agencies have for sometime now fraudulently claimed and abused as if they were the Crowns’ possessions. 3. The Commonwealth, State and / or Territories, and Local governments of the Crown do NOT speak for any of the Tribal Council Member Tribes nor their lands, peoples nor other interests nor assets including natural and other wealth. 4. We demand the return of OUR tools, implements, and sacred objects so as to be able to properly perform our beliefs and culture and our Sovereign Ceremony and so as to avoid further the genocidal effects of the Crown’s governmental policies since settlement. 5. We demand the destruction of any and all birth certificate documentation held by the Crowns agents /agencies in respect of Our Tribes Members, who are NOT and NEVER have been British subjects, and therefore never subject to British or quasi British /Australian statute. 6. We demand the ceremonial and all other artifacts, objects and materials of whatsoever kind and type which have relevance to Our member tribes be immediately returned to Our Tribes, this includes ALL ancestral remains. We demand the Crown and its’ governments to immediately come to the table to discuss with the Tribal Council the following significant issues: • Health • Education • Housing • Issues to the continuing genocidal practice of the kidnapping and moral destruction of Our children and families. • Law and Justice • Compensation for the Crowns unlawful use, abuse and sale of our Tribes people, natural and Other wealth and lands. • Our lawful right to use Our Natural medicines and practices • Issues relating to the Stolen Generations • The return to and burial of Our Ancestors into Our respective Tribal grounds • The right of Free Passage Over each others Tribal lands including any roads, highways or byways. 8. Further, we demand evidence from the Crown and its’ agents and agencies of their claim to any form of right to either occupy and or claim of ownership to Our indisputably Sovereign Tribal lands. We give advice that all member Tribes of the Tribal Council here have been selected and presented by their Tribal Councils and communities and as such are the only people authorised to speak for or on behalf of their Sovereign Tribes and country. We further advise that the National Congress of Australia’s First People, as a public company, registered within the Crowns’ own jurisdiction, and other government, quasi-government, public or private entity does not, cannot and will not possess (continued page four) End of Page Three Page Four Gabbi Kumera Declaration at Ernabella (continuing from page three) any authority – implied or otherwise – to speak, negotiate or or otherwise represent the Member Tribes of this Tribal Council. The Crown and the Governments of the Commonwealth of Australia and the several States and Territories, and local governments therefore have 14 days from the date of this Notice to respond with their final intention in respect of this Notice. If the Crown and the Governments of the Commonwealth of Australia and the several States and Territories, and local governments thereof fail to respond to this Notice they are irrevocably and unequivocally acknowledge that the Sovereign Original Tribes of this Island Continent have absolute ownership and Sovereign status in respect of this island continent, and agree to accept any decision or other order, decree or instruction made by either (of) the concerned relevant Sovereign Tribal Councils.
