Two former MIM corporators to be tried for inciting communal tension... HYDERABAD: The Telangana state law department has given its nod to prosecute two former Majlis-e-Ittehadul Muslimeen (MIM) corporators in a case of communal violence which was registered around two years ago. A government order was issued recently by secretary to the government, legal affairs and justice,A Santosh Reddy in this regard. According to sources, it was in November 2012 that the Hussaini Alam police had registered a case against former Shah Ali Banda division corporator Mohammed Ghouse and former Moghalpura division corporator Mohammed Mukarram Ali for allegedly inciting youths near Mecca Masjid after Friday prayers over the decoration of the Bhagya laxmi Mandir, the temple abutting Charminar. One Mohammed Mustafa Ali alias Muzaffar, an alleged accomplice of the duo, was also charged. The accused have been charged under sections 153 (A) (promoting enmity between different groups on grounds of religion), 353 (assault or criminal force to deter public servant from discharge of duty) and 147 (rioting) of the IPC. Sources said that as a rule, it is mandatory for any investigating agency to obtain prior permission from the government to prosecute a person booked under Section 153(A). The government said that it was satisfied and considered that the accused corporators should be tried for the offences, a source, who did not wish to be identified, said. The accused were reportedly absconding but surrendered before the court,the source added. The case was later transferred to the Special Investigation Team of the city police. The police had sought permission from the director of prosecutions to prosecute the duo on December 21 last year. Permission has been accorded now, he said.After getting the governments clearance, we will not proceed with preparing a charge-sheet against the accused, said an SIT official associated with the investigation. Tension and sporadic acts of violence had rocked the Old City late in 2012 amid the controversial temple issue. Vehicles were burned by miscreants and stone pelting remained a common feature. The residents of the Old City found themselves in an uncomfortable position on account of frequent police checking in various parts of the South Zone. As many as 11 cases were book and around 25 persons were arrested in cases pertaining to arson and rioting.
