UGBA vs SUSWAM This case came up again today at the Supreme Court of Nigeria, court 2, with five justices constituting todays coram; Coomassie, Fabiyi, Galadima, Ngwuta and Kekere-Ekun. Barr Orkuma proceeded with an oral application to allow for the name ACN to be replaced with the name APC. The application was successful, with no objection from INEC, GTS and PDP. Our Prayer at the Supreme Court: That the SC sets aside its judgment of over this matter. The prayer was however withdrawn because APC did not attach the subsisting judgment as exhibit. There was no objection from the respondents. The Court went ahead to strike out the withdrawn prayer. The APC is expected to file a fresh application attaching a copy of the judgment and the appellants have also been advice to ask for a full court of seven Justices in their new application.Meanwhile appeal number 191A earlier slated for 19/11/13 has been shifted to 26/11/13 at the instance of the SC. This appeal borders on NON PRESENTATION OF CERTIFICATE BY GTS. In a question for clarification to us the APC supporters, Bar. Moses Atagher told us that taking a hint from todays proceeding, the legal team will file application withdrawing the earlier one and file another containing the prayer for full court, that is seven justices of the SC., and will also attached a copy of the reported case in law review journal, though up to now, SC has refused to avail APC of the copy of their judgment given GTS victory. We shall meet again on the 26/11/13 for CERTIFICATE case. Damian Dodo SAN and Jibrin Okutepa SAN appeared for GTS and INEC respectively.
