UPDATE: For my peers reading this letter who dont agree with my terminology this letter is not about terminology it is about stopping the human rights, civil rights violations, beginning reform in a mental health system that is what I believe to be the same corruption going on in the 60s but better covered up due to organization on all levels. If I need to go to Washington DC and be the only person out there protesting with a sign in my hand than I will do it in the freezing cold. This has to stop! What I have heard over the past few weeks of stories from parents, aunts and patients of those who have encountered New York Presbyterian Hospital Psychiatric Division is disgusting. One young man had been so badly traumatized he committed suicide, another 16 yr old girl witnessed a physically disabled patient being physically abused, noticed the patient advocate sign called, the doctor and staff found out, was placed on one to one 24/7 w/ a male. The kicker is that she had been abused by a male her mother told them this that she could not be with a male and they punished her four reporting abuse for the remainder of her time. I am sure there is much worse going on in the mental health system, we are not being loud enough. When I see thousands marching because of racial disparities it makes me sick that we are not out there marching in our own group. There are thousands of us! Dear Congressman Maloney, In early December I spoke with your Deputy Director Genevieve Kessler regarding the civil rights human rights and HIPPA violations during my hospitalization at New York Presbyterian Hospital in February of 2012. One would hope that she advised you of my visit and brought you up to date on the binder with over fifty pages of documents including but not limited to a court hearing transcript, medical records, motions to the westchester county supreme court, status notes and more. These documents are of significant importance because they show the professional misconduct, criminal intent, civil rights and human rights violations committed towards me by Dr. Xiaolei Baran and New York Presbyterian Hospital. I brought this case to the attention of Senator Greg Ball and the Department of Justice who has failed to act ( DOJ has failed to act ) and that is why I have brought it to your offices attention. This email is not only a follow up to my visit to your office, but I would like to speak before congress and testify about the failure of the mental health system and protections that are put in place but are inadequate. It is much more than that. There is a bill being pushed by Representative Tim Murphy HR3717 which touches upon every aspect of my case and in that bill he proposes that forced treatment is the only way. What he fails to mention is the inadequate protections as in my case when doctors like Dr. Xiaolei Baran are backed by powerful hospitals and are able to use a corrupt system to do however they please. For example, During Treatment Over Objection Court Hearing Dr. Baran stated that I had two staff watching me by my side, I was sleeping and tried to hang myself. This is physically impossible. Keep in mind a judge presided over this case and the record reflects this statement. She was questioned twice about this so it was not a mishap statement. My attorney who I paid 2,500.00 for out of my own pocket the day of the hearing came to me, said the hospital attorney will take ECT off the table if we agree not to get an independent psychiatric exam. They plea bargained my brain as if I was a criminal. These are two examples of many how a mental health system has inadequate protections to protect not only myself, but some of the most vulnerable people in our population. Now you have a Congressman who wants to almost diminish these inadequate protections, publicly stigmatize the mentally ill by taking instances of school shootings and exploiting the mentally ill by saying their violent and there the reason for the shootings. Then make amendments to HIPPA , create criminal mental health courts for our Veterans which would ultimately violate their second amendment rights and never address their real issues like PTSD. Congressman Maloney, It’s been almost two years of fighting for justice in my case. I have put a lot of work and hard effort into this, thousands of dollars in debt, to fight a mental health system that is broken and which has ruined my life in more ways than one. I am not doing this for just me. I am doing this for the millions of Americans that deserve adequate mental health services, free of stigmatization, with dignity, respect and not having their civil and human rights violated. Change exists because people speak up and are eventually heard. One day I will be heard and hopefully it will not be because Dr. Baran has harmed more patients or more lives are lost at the hands of the mental health system. I appreciate your time and attention.
