UPDATE ON THE COURT PROCEEDINGS BETWEEN ABRAHAM ABADOS AND THE NIGERIA POLICE. Sequel to the illegal arrest,torture,detention and parading before news men of Mr. Abraham Abado between the 18th and 20th of Dec. Mr Abado on 8th of January 2014 proceeded to the court for the enforcement of his Fundamental Human Right (1999) and the African Charter on Human and Peoples Rights. Mr Abado Abraham and Deacon Toryila Amber (who was also involved) have jointly prayed the court to order Nigeria Police to write a written apology to them, 2. To direct the police to same publish in two national dailies 3. To restrain the police from any further invitation in respect to the case. 4. To order the police to pay N200,000000 as damage to reputation. When the matter first came up for hearing,the lawyer to the police filed a preliminary objection which was only served in court on that day as a result,the presiding Judge Justice Aondoaver Kakaan gave a short adjournment to 17th feb. to enable the plaintiff lawyer to the preliminary objection. In the preliminary objection filed by the police they among others claim that. 1. We were never paraded before the press,that the press only got the information through information gathering. 2. That they never kept me longer than permitted by the law. 3. That the arrest was based on report by a lady from kanshio. 4. That (Abado Abraham) was arrest for questioning the police. When the matter resumed hearing on the 17th of feb. Lead lawyer to Abado and Amber responded by- 1. Attaching sworn affidavit of Three people who watched the parade on NTA,on the 20th Dec. and 22nd of Dec. 2013. 2. Tendering the press release of the Commissioner of Police to the press where the names of Abraham Abado and Deacon Toryila Amber were mentioned. 3. Prayed the court to strike out some certain argument of the police as not been facts but arguments. 4. He further averred the court that even though the police were acting on the report of a complainant,the said complainant mentioned specific names of people who robbed her but never mentioned (Abado Abraham or Deacon Toryila Amber). Lead lawyer to Abado and Amber in hearing asked the court to determine if mere asking a police man question,makes one a criminal ot armed robber to be paraded on the screen of television. * That if the police claimed that they promptly released the plaintiffs when they discovered that they were not criminals,why did they have to keep them for 3days and parade them before the press as criminals before releasing them. In his defence,lawyers to the police Barr. A.S Ogungbe,urge the court to strike out the case for using the term armed robbers and not fraudsters suspect as claimed by the police,therefore making the statement of plaintiff inconsistent. He further urge the court not to accept the proofs tendered in court as they were public documents that was not certified. Barr R.A Mom for the plaintiffs however responded by saying that the use of the term fraudsters by the police was an after thought by the police and urge the court to grant the prayers of the plaintiff.
