US Banks lawyers latest tactic was to write me and inform me that they dont consent to electronic service. [I have two active cases against them on the same property in appeals court -- California and Federal.] I know they are trying to make life difficult for me by driving up mailing costs. They have four lawyers working on the case out of two different offices and are trying to break me with mailing and duplicating costs. Guess what? They lose. Why? Because they started it! They served me using electronic service first. I will write them a letter informing them of their two choices: 1. Admit that they served me first and therefore waived the right to refuse electronic service OR 2. Admit that they did not serve me with the Designated Record on Appeal and are therefore in default on the appeal and lose. --------------------------------------------- Rock and hard place, that is where I like to place the opposition.
