Under s44 of the Crimes (Sentencing Procedure) Act 1999, prior to sentencing an offender to a jail term, a non-parole period must be set by the court. The non-parole period is the minimum length of time an offender is required to be in jail. After this non-parole period is set, the remainder of the sentence must not exceed one-third of the non-parole period unless the court decides that there are Special Circumstances.
