Update in Deutsch & English (below): Geplante Abschiebung am Montag, 18.November 2013 - nach 10 Jahren legal in Österreich! Nyatta J. stammt aus Gambia und ist seit Jänner 2003 in Österreich. Die Polizei plant, ihn am kommenden Montag um ca. 4 Uhr morgens nach Gambia abzuschieben. Derzeit ist er im Polizeianhaltezentrum Hernalsergürtel 6-8, 1080 in Schubhaft(zuständig: Mag. Steinwender). Wir fordern: Keine Abschiebung von Nyatta nach Gambia, sondern humanitärer Aufenthalt in Österreich! -------------------------------------------- Hintergrund: Nyatta war fünf Jahre verheiratet und somit regulär als Ehemann einer Österreicherin mit Visum zum Aufenthalt berechtigt. Leider ist die Ehe in die Brüche gegangen. Er arbeitete laufend und erhielt neue Visa. Ein neuerlicher Antrag wurde abgelehnt, wovon Nyatta nichts wusste. Während er immer noch auf die Erteilung des Aufenthaltstitels wartete, wurde am 25.08.2013 in Schubhaft genommen. Warum Nyatta Aufenthalt in Österreich braucht: Nyatta ist schon seit 10 Jahren in Österreich und gut integriert. Er hat ein B1 Deutsch-Zertifikat und immer gearbeitet während er Zugang zum Arbeitsmarkt hatte, zum Beispiel als Küchenhilfe in dem bekannten Lokal Freiraum (Mariahilfer Straße), und zuletzt als Leasingarbeiter. Nebenbei machte er auch soziale Arbeit als persönliche Assistenz. Nyatta hat kein Aufenthaltsverbot durch wie auch immer geartete Strafen erhalten. Das Bundesasylamt hat Nyatta´s Antrag nicht inhaltlich geprüft und abgewiesen. Dies ist in erster Instanz generell so üblich, da nur die 2. Instanz unabhängig und mit mündlicher Verhandlung prüft. Deshalb muss der Asylgerichtshof aufschiebende Wirkung gewähren, um die rechtmäßige Beschwerde prüfen zu können. Diese könnte immer noch erteilt werden, genauso wie der Aufenthaltstitel durch die MA 35: Nyatta Jatta hat interessierte Arbeitgeber und alle Vorraussetzungen für ein Visum/Rot-weiß-Rot-Karte. Dafür appellieren wir dringend an das Innenministerium! Und an die Fremdenpolizei: Stoppen Sie eine Abschiebung, damit der rechtmäßige Aufenthalt auch weiter fortgesetzt werden kann. Wir fordern: Keine Abschiebung von Nyatta nach Gambia, sondern weiterhin Aufenthaltsrecht in Österreich! ------------------------------------------ Information in English: Nyatta must stay! Deportation planned on Monday, 18th of November 2013 – after 10 years in Austria! Nyatta J. from Gambia is since 2003 in Austria. The police wants to deport him on Monday, 18th of November around 4 a.m. - he is now in the deportation prison Hernalser Gürtel 6-8, 1080 Vienna (responsible person: Mag. Steinwender). There is a registered rally on Saturday 16th of November 1 to 3 p.m. - come and invite friends to fight for Nyatta! We will demonstrate in front of the detention center and demand: No deportation of Nyatta to Gambia and humanitarian stay in Austria! -------------------------------------------- Background information: Nyatta was married five years and had a legal status as husband of an Austrian woman. Unfortunately they divorced. He kept working and achieved new visa. He didn´t know that his Visa application was rejected and was still waiting for it, when, on the 25th of August 2013 the aliens police took him to deportation prison. Why Nyatta needs/wants to stay in Austria? He is here since already 10 years and so called “integrated”. His german level is on B1-level, he was working here that time he had access to the labour market, for example as kitchen helper in the well known bar/restaurant “Freiraum” (Mariahilfer Straße) and at least as Leasing-worker. He also was working in a social work with handicapped people. Nyatta wants to spend his life in Austria. There is no residence prohibition or other reason for him to leave. The national asylum office refused the application of Nyatta. The asylum court (as the European court of Human Rights) didnt react on the complaint/appeal and didnt grant a suspensive effect. But this could still happen, also the residence title from the MA 35 since Nyatta fullfills all the necessary terms for a working visa. Therefor we call urgent to the Ministry of the Interior and the aliens police! Stop that deportation! We demand: No deportation of Nyatta to Gambia!
