Upon appointment by US president Obama,one question the appointees gave to answer is:As Secretary of State/Justice/Defence,would you advise the president to have the US ratify the Rome Statute?....the answer to this is always emphatic No,Never or the US should never cede its soveregnity to ICC. While chairing a sub committee in 1998,a senator Grams,said: While I am relieved that the administration voted against the treaty of Rome,I an convinced that it is not in itself sufficient to safeguard our nations interests.......because the treaty establishing ICC is not only bad but also very dangerous None of us would want to see a court that flivorously prosecute Americans or which act with politics,not justice as its ultimate force. India and China have also refused to cede to the statute over the courts jurisdiction and the powers of the prosecutor.The fears are the prosecutors powers are too broad would lead to subjectivity and arbitrariness in investigations and prosecutions. There is a close relationship between the funding and the influence.60% of the funding is done by EU.....other funding also come from NGOs.The fact that some of them provide information to the court can and have contaminated the neutrality and credibility of the court. Under the current structure,ICC continues to lose support.Its scope of powers and esp the office of the prosecutor is too broad and wide open to political msnipulations that its only irrational to expect fair adjudication of justice. In essence, the court is its worst enemy and living to the claims of an International Colonial Court.The future of this court is either radical reforms or a funeral
