"Upon distant reflection the Plaintiff now realizes that in reality this attack represents Orlando’s first and only attempt to negotiate for the pending 2001 civil lawsuit against them. This behavior is extremely uncivilized and is a violent attack from a guilty defendant seemingly desperate to avoid appearing in court or making any statement whatsoever, with no legitimate defense and no way to pay for their prior torts. In reality, however, as the court is aware, the Defendants don’t have the excuse of desperation and never did. This behavior in the part of Defendants is heinous, criminal, and utterly inexcusable. The court is well aware that the Defendants are fully insured, double indemnified by the state, and triple indemnified by a number of fraternal organizations. Further Defendant City of Orlando is far from poor, having bragged for months and years immediately after the incident about spending $400 million on a new NBA arena, $400 million on a new “performing arts center,” and $2 billion on a combination package for a new NFL stadium for and NFL team that doesn’t exist. A modern art collection paid for with taxpayer money and worth several million dollars occupies 3 floors of their city hall. The day that this motion was completed Defendant continued to brag to the public that they were acquiring new outdoor sculptures worth $1.5 million, having never made any civilized peaceful offer for the pending lawsuit. Instead of ever making a minimal 5 figure offer for their 2001 torts, these Defendants chose to participate in behavior that is the equivalent of the numerous violent state and federal crimes listed above. Their behavior constitutes (at a minimum) stalking, battery, aggravated battery, aggravated battery upon a disabled person, aggravated battery with a weapon, and perjury (falsifying a police report).
