The question in politics that one must always adhere to: even if one is right in principle, will the Court of Public Opinion dictate otherwise.... Trying cases in the court of public opinion refers to using the news media to influence public support for one side or the other in a court case. This can result in persons outside the justice system (i.e. people other than the judge or jury) taking action for or against a party. For instance, the reputation of a party may be greatly damaged even if he wins the case. It has been noted that there is no Fifth Amendment right against self-incrimination in the court of public opinion according to J Marquis (2005), The Myth of Innocence, Journal of Criminal Law and Criminology. When training organizers for any political campaign, I routinely drill in their head this one constant: though you may not be on the clock 24/7, you must behave as though you are, your actions can sink a candidate merely based on appearance, whether you are right or wrong... I hope Senator Augare is able to recover from this, his representation of Blackfeet people in politics and government has been just, noble and has furthered our influence at the policy table on several levels in several governments, but my notion is the fickle reality of public opinion will more than likely dictate the outcome.
