Webster Police above the law? This is the text from the posted story on WPD Facebook page; At approximately 2150 hours on July 8th, Webster Police received a call from the clerk at Jimmie’s Convenience store reporting he had just been robbed at knife point. Officers Joshua Collins and James Young Jr. arrived on scene and obtained a description of the robber, as well as the license plate and description of the car which he was driving when he left. He did obtain over $200 from the clerk. An alert citizen spotted the vehicle on Maynard Avenue after overhearing a broadcast given out to area departments over a police scanner and called the police department. After a brief investigation conducted by Officers Bruce Hamm, Donald Southall, and Michael Lee responded to that location and eventually arrested James Paul Ingram 4/17/86 60 Old Spencer Rd. Charlton Ma. Recovered in the investigation was cell phone used to call the store a short while before the robbery occurred. Ingram was charged with the following: Armed Robbery Assault Larceny over $250 A second female may face additional charges. Ingram was arraigned at Dudley District Court where he was held on $2050.00. K9 Officer Jason Burdett and his partner Jago assisted in the investigation by trying to locate missing evidence. What the story doesnt say is that after apprehending the suspect (he was in cuffs and sitting quietly) the WPD decided to look for evidence (the weapon used in the robbery, a white baseball cap, and an undisclosed amount of money). The suspect was caught on the street that abuts my backyard. I am the homeowner. I was home at the time. The WPD called a K9 officer and waited for that officer to arrive. During this time, they neglected to ask me for permission to search my property. They did not have a judge issued warrant. They did not walk around my house and open the gate to my backyard. They decided to CLIMB MY BRAND NEW FENCE! Back and forth WITH THEIR DOG!! In the process, they broke my fence. The next day, I noticed the broken fence. While examining the damage, my neighbors informed me that they watched the police climb back and forth with their dog until the fence broke. At least ten witnesses. I called Lieutenant Shaw to complain about the damage and to ask to be compensated. I also informed Lieutenant Shaw that searching my property without a warrant issued by a judge or my permission, was a violation of my 4th Amendment rights. Lieutenant Shaw disagreed and said that they (police) can take certain liberties with rules in situations like these. No offer to compensate. No apology. It was their right to enter my property like commandos and damage my property and then leave without ever informing me they were there or that they damaged my property. I asked him why they didnt at least inform me that they had damaged my property and he said they did not have to. He then informed me that I need to speak to the Town Administrator to possibly be reimbursed. He also told me that the State Attorneys office would take my 4th Amendment violation complaint. He wanted to terminate the call and at one point said sarcastically, Im sorry you think my officers damaged your property on purpose. Hardly an apology and I never once said anything about their intent. I only complained that they damaged my property…not that they did it purposely. Repairing a fence is not cheap and it is not easy. I am including a picture of the fence before it was damaged (taken July 4th 2014) a picture of after they damaged it, and a picture of the repair. The WPD are NOT THE LAW and they are NOT ABOVE THE LAW! They are paid to UPHOLD THE LAW. They took an oath to protect my (and your) rights. They DO NOT HONOR THEIR OATH! I am disgusted with what they did to my property and how they treated me. I havent decided what recourse I will take.
