What is a Civil Matter? A civil matter arises from a dispute between two parties. Example: Adam lends R500,00 to Peter and Peter fails to pay the R500,00 back to Adam on the agreed date. Adam then institutes an action against Peter. This action is initiated by means of a letter of demand and thereafter a summons. Civil action can also commence by means of an application process, e.g., a spoliation order or an interdict. Sometimes a problem needs to be sorted quickly, for e.g., if your bicycle is stolen and you know where it is, you can go to Court to have it returned immediately. This process is called spoliation. The party who has the possession of that property can apply for an interdict in Court, preventing the person who claims to be the rightful owner from taking it back until the matter is sorted out in Court.
