What people fail to realize is that grand jury proceedings are not your normal “trail by jury.” Grand jury proceedings are controlled, paced and manipulated by the Prosecutor. Why is this important to note? The District Attorney or State Attorney/Prosecutor usually works very closely with law enforcement supporting and using police officers as credible witnesses to bolster their case against the defendant. Many cases were won on the back of that officer’s credibility therefore solidifying Prosecutor/Police relations and said Prosecutor’s reputation and “win” record. The prosecutor will not shoot himself in the foot or undermine his forged relationship with law enforcement nor risk maligning or aiming a wrecking ball at the credibility of officers who had previous served as character witnesses winning his cases nor jeopardizing his own win record. If the prosecution indicts an officer he/she risks sullying relations with law enforcement and the potential re-trying of any case by a defendant that was put-away by the said credibility of that officer. That being said the prosecutor in the Ferguson grand jury trail didn’t even cross-examine the officer…no, not even one question. Ferguson is comprised of 67% black residents. The grand jury selection and makeup of jurors contained only 1 black man, 2 black women and 9 white women. Not even half of the jury reflected the community. The Eric Garner grand jury trail selection was just as suspect, only 5 out of 23 jurors were black. There was a video of the incident and the State medical examiner’s report that ruled the death of an unarmed Eric Garner as a homicide by chokehold. Point being, no one has the right to shoot 8 bullets into an unarmed man nor taking the life of an unarmed man with a chokehold.The judicial system needs to be fixed.
