When I can’t find the admin judge to see about getting deferred, I return to Court #9. This time, I feel I have seen enough of the courts integrity. I talk to the court bailiff instead of the prosecutor. The bailiff acts like he doesn’t want to help. He says he doesn’t have any paperwork and that he didn’t know if the judge would see me since I had been dismissed from his courtroom. I tell the bailiff I am seeking deferred adjudication. The prosecutor smiles upon hearing this. I hand the bailiff the paperwork that he had given me the first time and which had been returned to me by the prosecutor. He approaches the judge’s bench to make my request. To no surprise, the off-docket judge of court 9 shows as much eagerness to grant me deferred as the admin judge had in the hallway. Neither judges’s willingness to grant me deferred was constrained by the fact that I had a future court date on 2-4 or even that my request was being submitted 21 days after the date of my citation (12-4-12). The off docket judge says, “get up here”--he, too, wanting to resolve the issue as quickly as the admin judge. I present my paperwork to the judge; it looks the same as it did when I presented it to the prosecutor.(with both deferred and dismissal due to prejudice marked). After beginning to vocalize that I had seen the admin judge in the hallway and he was going to grant me deferred, the off-docket judge interrupts me and tells me to go back and see Judge S. The Bailiff (a city employee) thanks the judge for his assistance--again, reinforcement for this judges effort to cover for the courts admin judge. Unable to enter deferred adjudication into the record, I draft a brief letter requesting deferred adjudication and submit it via the clerk of the court that afternoon on 1/11/13. Although my letter for deferred was being submitted more than 21 days after the citation I received, and even though it contains only one word referring to the fact I had a court date, it was obvious to anyone that read my letter that I had tried to get deferred through an off-docket earlier in the day and that two judges, who I encountered, expressed willingness to grant me deferred. It ends by mine expressing frustration at trying to get deferred adjudication at the courthouse. “Given the runaround I am being given and the prejudice and bias encountered by the judges and prosecutor, I am forced therefore to file my motion for no contest/deferred adjudication via the Clerk of this Court. Sincerely submitted to Judge Solis’ courtroom as requested via ex parte communications by Judge Solis.”
