Staff must treat detainees with humanity and with respect for the inherent dignity of the person. Failure to do so may cause serious harm to detainees, and result in serious consequences for the staff concerned. Australia’s human rights responsibilities and duty of care to persons in immigration detention apply regardless of whether detention or aspects of detention are contracted out to private companies. 7.1 Accountability and contract management Standard Sources Where detention or aspects of detention are contracted out to private companies, the Australian Government retains responsibility for human rights protection and a non-delegable duty of care.
