Wisdom behind the One year deferral request by the AU. President Kenyatta has not requested for his case to be deferred for a year at the Hague... The applications before the Hague are for 1)Stopping the proceedings due to abuse of the Court process by Persons associated with the Prosecutor. 2) Court to grant the Duo UhuRuto the right to attend trial via video link (If request one above for Uhuru is not granted) Those are judicial Processes that will be determined by the court through the judges. I have always held the view that deferral for the sake of it is Just Postponement of the Problem... Then the AU Leaders met.. Respected men and women in the continent... Men and women whose word in the continent is binding. Among the resolutions passed is A one year deferral request to be tabled to the UN security council for consideration... If that request is not granted then eventually Mass walkout of the African states will be considered... Mass walk out of African states is the Final Killer blow to the court. There can be no ICC without African states. Its a court to Prosecute third class Citizens of the world. Its a racial court. Its a court that speaks to the fact that Colonialism and racialism is still with us. That AU request is a Political request... It will be handled politically by the member states.. Its aimed to send the following messages 1. That since the trials of UhuRuto are political then the AU is determined to deal with them Politically.. 2. That the AU having realized the trials are political is demanding that the two Leaders UhuRuto be allowed to continue discharging their constitutional obligations to Kenyans as the Forensic side of the case as The President called it, is being handled by their very competent Lawyers. That will require an amendment to the Rome statute to accommodate these demands, an amendment that will require due Political consideration and TIME by especially the big five funding members... Already the AU insist they will be introducing a raft of amendments that will in their own words strip the ICC of high-handed powers, curtail the hand of the prosecutor and reduce the court to a third option.. The AU is telling the ICC that we know this court is a neo-colonial racial outfit, before we leave it we want to destroy it in the best way we know how... The UN security council has limited options, its damned if it doesnt play ball,...... from where I sit its not if But when the ICC will be killed and buried by the AU~ because true Justice is supposed to be blind to the color of you skin or the depth of your pocket and be dumb and deaf to the politics of the day for all men were created equal!
