With the national spotlight on western North Dakotas flaring of natural gas - and tribal council elections pending - Sovereignty-by-the-Barrel finally had to do something about the wasteful flaring of natural gas and propane on Fort Berthold. And all the industry folks that Sovereignty always saw as their friends? With Kodiak and EOG already filing in federal court for federal injunction against the individual tribal members flaring lawsuit in Ft Berthold Tribal Court, the industry is - this time - challenging the tribal councils jurisdictional scope over the wasteful flaring of natural gas and propane. Industry officials are questioning whether the tribe has the jurisdiction to impose such fees and warned that the change could slow oil production on the reservation. Well then - with a new tribal administration from the tribal elections this fall and if the industrys threat of a slowdown in production actually happens, we could actually have time to get some new, strong industry regulations and infrastructure developed within Fort Berthold....because you know, theyll be back. Its interesting that the industry says the mineral leases are a legal binding agreement...and yet, all of a sudden, theyre threatening to leave. Aside from the air pollution costs on Fort Berthold from flaring, over $1 million a month in North Dakota tax revenue is lost - thanks to the Republican-dominated legislatures previous approval of the wasteful flaring of natural gas. And remember, state elections are pending also.
