Word to the Wise When involved in a crash, should you (yourself) report the crash to your insurance company? Part 1 If you are covered under a policy, there is a duty to report the crash, for the specific purpose of providing ample time to investigate the crash, and for the insurer to take necessary measures. If the insurer is prejudiced, because the crash was not reported, then there is a possibility that your claim will be denied. Notwithstanding, it is my suggestion that you have your attorney, or the attorney’s staff, make the report. This is normally done by phone. When the insurance adjuster asks you questions pertaining to the crash, they are seeking not only information determine to the crash, they are also looking for information that will justify them in denying your claim. There is no room for lies or deceptions. The truth must be told! However, be vigilant as to the type of questions asked. Be suspicious of leading questions (questions that suggest an answer); such questions may be ambiguous and may lead you into a trap that may justify the insurer in denying your claim. This is the reason why your attorney, or his staff, should report the crash in your behalf. In addition, you want the appropriate “reserve” to be set aside.
