Yesterday, the Indiana Supreme Court continued their discussion of the case below, hosted on campus in Stewart Center. In March 2010, a woman about 7 months pregnant contacted Catholic Charities; she did not identify the father. Catholic Charities reached out to a potential adoptive couple. The birth mother signed the appropriate adoption paperwork after giving birth May of 2010. The newborn was placed pre-adoptively with the couple, who twice signed paperwork acknowledging they understood this was an at-risk placement – either the biological mother or father might later challenge the adoption. The babys birth father contested the adoption. In January 2011, the trial court awarded custody to the father, and the couple sued Catholic Charities for negligence; the trial court ruled in favor of Catholic Charities. The couple filed an appeal: The Court of Appeals found the appeal to be in favor of the couple. Catholic Charities filed a petition to transfer asking the Indiana Supreme Court to accept jurisdiction, at which point proceedings are currently taking place.
