d. Dileep Patidar: Disappeared since 10.11.2008: i. Dileep Patidar, was picked up by the ATS Mumbai from Indore for interrogation in the night intervening 10-11th November, 2008. The ATS Mumbai officers took him to Mumbai under the garb of interrogation in Malegaon 2008 Blast case. Since, then said Dileep Patidar did not return back. ii. In the Habeas Corpus Petition before the Indore High Court, on 03.07.2012, CBI submitted a report in sealed cover before the High Court, wherein it is submitted by the CBI that whereabouts of Dileep Patidar could not be ascertained whether he has died or alive. CBI further stated that investigation is complete and the CBI is going to file the charge sheet against the accused officers of the ATS after taking sanction from the competent Authority. iii. Still whereabouts of the Dileep Patidar is unknown. No action has yet been taken to punish the erring officers of the ATS Mumbai. iv. Apprehension is that said Dileep Patidar was tortured to the extent that he succumbed to the torture and died at the hands of ATS Mumbai. v. Against the said order, the father of Dileep Patidar has filed the Special Leave Petition in the Supreme Court, wherein Notices have been issued by the Court.
