Wearing message clothing is a right of free speech when students are generally permitted to wear such clothing in school. Religious students must be permitted to display both political and religious slogans or logos on clothing, such as T-shirts or sweatshirts, when other students are permitted to wear clothing with other messages or logos. A school may, on the other hand, prohibit all students from wearing message clothing. If that rule is applied equally to everyone, no matter whether the message is religious or secular, then religious students do not have the right to wear their religious clothing. Students must be careful not to wear message clothing with language that denigrates other religions. This could be considered uncivil or obscene speech, which may be legally prohibited in school. School officials often claim that certain speech, generally, proselytizing or pro-life messages is offensive to others. However, a school may not curtail freedom of speech just because the message offends someone. Courts have held that if the message on clothing offends a viewer, he is free to avert his eyes and not look at the message. In contrast to a students right to wear religious jewelry or clothing with religious messages in school, a teacher is more limited, particularly with respect to clothing choices. Generally, a school district may prohibit a teacher from wearing religious garb or clothing with religious messages in order to promote an atmosphere of neutrality about religion in the public school classroom. On the other hand, teachers may wear such religious jewelry as cross necklaces or angel pins in the classroom.
