أعرض عليكم أيها الأخوة والأخوات الأعزاء أهم وأخطر رسالة قمنا بإرسالها للمجموعة الاستشارية حيث قام مكتب المحامي البلجيكي ( لوك جايسنز ) بالرد على هذه الرسالة والتي أرسلناها وتم الرد عليها بتاريخ 2011/3/26 وضمت معلومات وحقائق مذهلة تدل على عدم مصداقية رئيس الجمعية ( المخلوع ) والاختلاف الكلي لما كان يروجه عما صرح به المحامي ( لوك ) ولكم الأسئلة وترجماتها : Dear Messrs, (Litigation support and legal team), Good Day, 26-3-2011 Subject: The cooperative society Of The Gulf War Returnees – Jordan - Our Case السادة الأعزاء/ فريق التقاضي والدعم القانوني – يوم سعيد 26/3/2011 الموضوع: الجمعية التعاونية للعائدين من حرب الخليج – الأردن - قضيتنا Introduction: We really felt happy about your kind responses was sent to us by a friend of ours who is a member of the cooperative society Of The Gulf War Returnees - Jordan as we are members also. In the same time we felt so sorry, frustrated and deeply depressed about our Cooperative suspicious behavior, and our case in your safe hands is as we more and more likely feel that it has been compromised and we really feel that there is evil hidden hands tampered and manipulating with our case by away or another locally and regionally (Our Cooperative + Kuwait government + our government in Jordan) in fact we suspected you also, sorry. We really want to put you in the local real picture that you have asked for which we almost described in the above mentioned, plus , we have been reading and recycling publicity between each other since 2009 which was more powerful since 2004, and our Cooperative have been handing over these newspaper articles which is mostly says the same words that our compensation has arrived to Jordan since the end of 2009 and finished in the beginning of 2010 by a suspicious actions no one knows about it and we have no evidence proves it, but we got sure of one thing which is more than 5 billion dollars has been transferred to the central bank of Jordan from Kuwait from a reliable sources of Kuwait and Jordan. We put confident of your kind side to have our questions crystal clear answered as soon as possible as most of our Cooperative members always ask, our question is as follows: مقدمة: لقد شعرنا حقاً بالسعادة بسبب نوعية الردود التي أرسلتموها لنا عبر صديقنا والذي هو عضو في جمعية متضرري حرب الخليج – الأردن كما أننا نحن أيضا أعضاء فيها. وفي نفس الوقت شعرنا بكل أسف بالإحباط والاكتئاب العميق بسبب الممارسات والتصرفات المشبوهة لجمعيتنا وقضيتنا التي هي بأيديكم الأمينة مع طول الوقت الذي مضى عليها، إننا نشعر بأن قضيتنا قد تمت تسويتها ونعتقد بأن هناك أياد شر خفية تعبث وتتلاعب فيها بطريقة أو بأخرى محلياً وإقليمياً وأطرافها هم (جمعيتنا + حكومة الكويت + حكومتنا في الأردن) في الواقع لقد شككنا بكم أيضا مع الأسف. نحن فعلا نريد وضعكم في الصورة الحقيقية لدينا محلياً حسب طلبكم والتي قمنا بوصفها بشكل مختصر أعلاه، بالإضافة إلى أننا كنا نقرأ ونتداول فيما بيننا ما ينشر من دعايات منذ عام 2009 وبشكل أكبر وأقوى من أي وقت مضى منذ عام 2004, وكانت جمعيتنا تقوم بإتوزيع نسخ من تلك الصحف والتي كانت معظمها تتحدث بنفس العبارات عن تحويل مبالغ التعويضات للأردن منذ نهاية 2009 على دفعات وتم إستكمال هذه الدفعات في بداية عام 2010 وبأن هذا الإتفاق قد تم بشكل مثير للريبة حيث أنه لا أحد يعلم عنه شيئاً وأننا ليس لدينا دليل يثبت ذلك، ولكننا حصلنا على تأكيد بأمر واحد وهو أن أكثر من 5 مليارات دولار أميركي تم تحويلها إلى البنك المركزي الأردني من الكويت حسب مصادر موثوق بها من الكويت والأردن. لقد وضعنا الثقة في طرفكم للتكرم بالإجابة على أسئلتنا بشكل جلي وواضح وبأسرع وقت ممكن لأن معظم أعضاء جمعيتنا التعاونية يسألون ، وأسئلتنا هي كالتالـــــــــــــي : Replied in 26/03/2011 - (Questions in Black & Replying with Red or Underlined) Ladies and gentlemen, Since our company has a website, many members or Gulf War Victims have contacted us. We cannot answer individually so please make sure that this message is sent to most of those who are concerned. We have no way to know what is going on between the Kuwaiti and Jordanian government, this a bilateral political issue, unrelated to the judicial case. In response to your questions we try to be as clear as possible and 100% transparent and with your lawyer we have prepared following responses... أيها السيدات والسادة ،، منذ أن أمتلكت شركتنا موقعا إلكترونيا والكثير من أعضاء جمعيتكم قاموا بالإتصال بنا. نحن لانستطيع الإجابة عن جميع أسئلتكم بشكل فردي ولذلك نرجو منكم أن تقوموا بإرسال مضمون هذه الرسالة إلى جميع الإعضاء وأصحاب العلاقة. سوف يقوم فريقنا القانوني قريبا بإعداد مقال عن وضع قضيتكم في صحفكم المحلية في الأردن وسيتم نشرها (نأمل ذلك) في الجرائد الأردنية. ليس لدينا أي سبيل لمعرفة ماذا يجري بين الحكومة الكويتية والحكومة الأردنية!!، هذه علاقات ثنائية سياسية وليس لها صلة بقضيتكم وبالاستجابة لأسئلتكم، سوف نحاول أن نكون واضحين 100% وبشفافية تامة وقد قمنا بجلب تلك الإجابات من محاميكم وهي كالتالي: 1- Is it prohibited to introduce our case to the publicity (Local & Regional newspapers & satellite channels) and is it a condition you have told our society to commit with and force the members to not have actions in?? And you exactly know about the power of media which surly can do to have our case win in the end and have more power than discreet. The more publicity is given to the case, the better it is. This case is in court since more than 10 years and the facts are 20 years old ! Without press and social network, it will be forgotten. You do not need permission from any court to talk about your case as long as you stay correct. We encourage the victims to testify about what they suffered on social networks and to publish images. 1- لقد قمنا بمحاولة إقناع أعضاء مجلس إدارة جمعيتكم بأن الإعلام هو المفتاح وهو العنصر الأساسي لنجاح قضيتنا وقضيتم، وحاولنا إقناعهم بأنه كلما كان هناك إعلام أوسع عن القضية كلما كان وضع القضية أفضل وأفضل. إن هذه القضية قد مضى عليها أكثر من 10 سنوات وبالأحرى 20 عاما من العمر، وبدون صحافة وإعلام سيتم نسيانها مع مرور الوقت. أنتم لاتحتاجون إلى تصريح وتخويل من أية محكمة للحديث عن قضيتكم طالما ستلتزمون بذكر الحقائق فقط. نحن نقوم بتشجيع الضحايا من جمعيتكم للإدلاء بحقائق ما عانوه من ظلم وتعذيب واضطهاد على القنوات المحلية والإجتماعية ونشر صور إن أمكن بذلك. 2- There was new members newly added to the membership of our Cooperative and the fees were raised frequently till it reached $ 1000. Did you raise these fees? Did you have these fees in your accounts? 2- لقد تم إضافة أعضاء جدد لعضوية الجمعية وتم رفع سعر الإنتساب للجمعية مع التسجيل في القضية حتى وصل بالمجمل 1000 دولار أميركي، هل حصلتم على أتعاب هذه الرسوم وتم إدراجها في حساب شركتكم أو مجموعتكم الإستشارية؟ 2- WE know nothing at all about these issues which are internal to the Cooperative !! We have never been informed about the amount of the membership, we do not get any portion of this money and we have never been informed about the financial condition of the Cooperative. We are NOT PAID by the Cooperative and have worked for free until now, we only get a portion of the global amount in case of success. 2- لانعلم شيئا مطلقا عن هذه القضايا والتي هي تعود بشكل داخلي للجمعية، نحن لم يتم إعلامنا مطلقا عن مبلغ الرسم لإضافة شخص ما لعضوية الجمعية ولم نتقاضى شيئا منها في حساباتنا ولم يتم إعلامنا من قبل الجمعية بشكل مطلق عن وضعها المالي. نحن لانتقاضى شيئا من الجمعية وقد عملنا بشكل مجاني حتى هذا الوقت، نحن سيتم الدفع لنا من المبلغ الإجمالي للقضية في حال كسبها. 3- How far if we win the case to have the defendant complies with it? 3- في حال كسبنا القضية ما مدى إلتزام المدعى عليها (دولة الكويت) بتطبيق الحكم الصادر بحقها ؟ 3- If we win the case, there are two potential verdicts : one is prison for those who committed crimes and there might also be a fine. In European Courts these fines are not high like in the US. These verdicts are compulsory, no way for the criminals to avoid or an international warrant will be issued against them. The criminals will not be able to travel anymore and will be put in jail. 3- ي حال كسبنا للقضية سيكون هناك شقان للحكم ، واحد بالسجن للمدرجة أسمائهم بإرتكاب جرائم حرب وغرامة مالية (تعويض) ، في أوروبا ليس هناك مبالغ لنفس النوع من هذه القضايا تكون المبالغ فيها بهذا الكم كما هو معمول به في الولايات المتحدة. تلك الأحكام إجبارية، وليس هناك سبيل مطلقا للمدعى عليهم أو المطلوبين بالتهرب من مذكرات ملاحقة دولية بحقهم ولن يكونوا قادرين على السفر وسيتم وضعهم في السجن في نهاية المطاف. 4- What it the basic elements or basis of our case which relays on? 4- ما هي العناصر الأساسية التي ترتكز عليها قضيتنا؟ 4- War crimes, genocide hopefully, human right violations and all violations that the investigation will reveal جرائم الحرب، القتل الجماعي ، خرق حقوق الإنسان وجميع الخروقات التي سيتم الكشف عنها في وقت لاحق عند التحقيق. 5- What is the minimum compensation for each member by your expectations and predictions? 5- ما هو الحد الأدنى للتعويض لكل عضو في الجمعية حسب توقعاتكم وتنبؤاتكم ؟ 5- We have calculated an average loss per family in Euros multiplied by the number of plaintiffs but we have no way to predict what a Court would judge and decide as far as compensation is concerned. In Europe billion amounts have never been awarded.. 5- لقد قمنا بحساب معدل خسارة لكل عائلة باليورو مضروبا بعدد أفراد المتضررين، ولكننا لا نستطيع التنبؤ بما يمكن أن تحكم أو تقرر به المحكمة من مبالغ في هذا التعويض، في أوروبا لم يكن هناك قضية من هذا النوع قد حكم بها بمليار يورو. 6- Is it real that some member’s files were dropped down because of been expelled from our Cooperative? If yes, is there files money values were deleted from the whole main file and deducted from the total of $ 3.2 billion?? 6- هل من الصحيح أن بعضا من ملفات المتضررين في القضية قد تم إسقاط مطالباتهم في القضية بسبب فصلهم من الجمعية؟، إذا كان الجواب نعم، فهل تم خصم مطالباتهم من المبلغ الإجمالي المطالب به في القضية؟ 6- There was an initial list of plaintiffs in 2001 and no names were taken off that list. Some names of plaintiffs have been added a few years ago but no changes have been made in recent years. 6- كان هناك تدوين للمطالبات في عام 2001 ولم يكن هناك أسماء قد تم حذفها من القائمة وقتها. بعض الأسماء الجديدة في المطالبات قد تم إضافتها منذ سنوات ولكن لم يكن هناك تغييرات حصلت في السنوات الأخيرة. 7- Did you put in consideration maximizing the total amount claimed more than $ 3.2 billion because of 11 years and maybe more?? 7- هل وضعتم في إعتباركم المطالبة بمبلغ أكبر من 3.2 مليار بسبب المدة الطويلة التي استغرقتها القضية في المحكمة ؟ 7- It is not relevant for the time being to discuss about this. First the case needs to be judged !! إن الأمر ليس بذي صلة في هذا الوقت للنقاش فيه، أولا القضية بحاجلة لأن يكون فيها قرار حكم !!. 8- What is the main reason which made our case goes back for the appealing court?? Is there any wrong took place in the court procedures or wrongs made in the judgment?? And is the judgment of 30/04/2010 is dropped down or failed?? 8- ما هي الأسباب الرئيسية التي جعلت قضيتنا ترجع إلى محكمة الإستئناف؟ هل حصل خطأ في إجراءات المحكمة أو خطأ بالحكم ؟ 8- The judgment of 30/4/2010 was dropped by the Supreme Court for legal considerations. The lawyer is working to present the case again in front of the Court of Appeal for a new judgment. 8- إن حكم أو قرار 30/04/2010 قد تم إسقاطه من قبل المحكمة العليا بسبب إعتبارات قانونية. إن المحامين يعملون في الوقت الحالي على ذلك مرة أخرى في محكمة الإستئناف لإستصدار حكم جديد. 9- What do you mean by away or another holding the responsibility for our Cooperative’s administration losing great opportunity in February (20th anniversary of the liberation of Kuwait)? And what could have been positively done in such month as far as your expectations?? It was our idea first place but our Cooperative administration ignored it and denies it strongly. 9- ماذا كنتم تعنون بالإجابة عن رسالتكم لصديقنا بأنكم تحملون المسؤولية على إدارة الجمعية لفقدان فرصة كبيرة في شهر فبراير (الذكرى العشرون لتحرير الكويت)؟ وماذا كان من الممكن أن يحصل بشكل إيجابي لو تم إستغلال هذه الفرصة في ذلك الشهر على حد توقعاتكم؟ لقد كانت فكرتنا منذ البداية ولكن إدارة جمعيتنا تجاهلت هذه الفكرة ورفضتها بشدة. 9- We recommended to launch a media or social network campaign to make as much noise as possible about your case during the period of the 20th anniversary of liberation of Kuwait in February which is also the anniversary for the expulsion of many Jordanian Palestinians from Kuwait !! We did nothing because we have no means to do it. 9- لقد نصحنا جمعيتكم بإطلاق حملة إعلامية على حملات الشبكات المحلية في الإنترنت لعمل أكبر ضجة ممكنة حول قضيتكم خلال فترة شهر فبراير الماضي المذكور والذي كان ذكرى في نفس الوقت لطردكم من الكويت كأردنيين وفلسطينيين!! نحن لم نقم بعمل شئ في هذا الموضوع لأننا لا نمتلك الأسباب أو الوسائل لذلك. 10- Did you hear rumors about transferring money from Kuwait to Jordan (The central bank of Jordan) by installments between 2009 & 2010 reached more than $ 5 billion related to assumed or possible settlement about our case?? 10- هل سمعتم بالإشاعات والتي مفادها تحويل مبالغ (أكثر من 5 مليارات دولار أميركي) من الكويت للبنك المركزي في الأردن على دفعات مابين عامي 2009 و 2010 متعلقة بتسوية مفترضة أو محتملة تتعلق بقضيتنا؟ 10- We are far from the Middle East and hear nothing. The case is in Court in Brussels in Belgium. How is it possible to settle without including the lawyer ? The lawyer acts on behalf of 8’000 individual claimants and not on behalf of the Cooperative. Only a decision of the general Assembly of the Cooperative and based on a vote of its members could withdraw the current lawsuit against the Kuwaitis. 10- نحن نعيش بعيدا عن الشرق الأوسط ولانسمع بأي شئ. إن القضية في محكمة بلجيكية. كيف يمكنهم عمل تسوية بدون علم المكتب الإستشاري والمحامين؟ إن المحامين يتصرفون أو يدافعون عن حقوق 8 آلاف فرد ولايتصرفون على عاتق الجمعية أو يدافعون عنها. قرار فقط من مجلس إدارة جمعيتكم مأسس على تصويت أعضائها هو الطريق الوحيد لسحب قضيتكم الحالية بمقاضاة الكويتيين. 11- Is the settlement solution were presented by Kuwait at any time during our case is taking place in court of law, this were published in our local Internet many sites?? Did Kuwait pulled out this settlement solution?? 11- هل تم طرح الحل الودي من قبل دولة الكويت في أي وقت من وجود قضيتنا في المحكمة؟ لقد تم نشر هذا الخبر في صحفنا الألكترونية في العديد من المواقع. هل قامت دولة الكويت بسحب هذا الحل الودي للقضية في وقت لاحق؟ 11- The Kuwaitis NEVER offered any settlement solution ! They put a lot of political pressure on the Belgian government to drop the case. We wrote a nice letter to the Kuwaiti ambassador in Brussels offering to sit around a table end of 2010 and they DID NOT EVEN ANSWER IT ! There was never any sign of goodwill from them 11- إن الكويتيين لم يقدموا الحل الودي مطلقا! لقد قاموا بوضع ضغط سياسي كبير على حكومتنا البلجيكية لإسقاط القضية. لقد قمنا بكتابة رسالة إلى السفير الكويتي في بلدنا نعرض عليه الجلوس على طاولة مستديرة في نهاية عام 2010 وحتى أنهم لم يقوموا بإجابتنا بالإيجاب أو النفي! لم يكن هناك بشكل مطلق أية نية حسنة من جانبهم تجاه عمل تسوية أو حل ودي لقضيتكم. 12- We were noted for a reliable source from Kuwait that there is unknown incident will take place in the end of March, 2011 related to our case, are you aware of this incident? لقد تم إعلامنا من مصدر موثوق لدينا في الكويت بأن هناك حدث هام سيحصل في نهاية شهر 3/2011 متعلق بقضيتنا، هل أنتم على علم بذلك؟ 12- ??? 12- لا إجابة ؟؟؟؟؟ 13- There is expectations from our reliable source from Kuwait that there is agreement took place between the Kuwaiti government and our Cooperative manager through our Jordanian government in a very secret matter to unknown date they are all agreed about, can you investigate that please?? 13- هناك توقع من مصدرنا الموثوق في الكويت بأن هناك إتفاق قد أبرم بين حكومة دولة الكويت وبين إدارة جمعيتنا والراعي فيه هو الحكومة الأردنية بشكل تكتمي للغاية وسيتم الإعلان عنه في وقت غير معلوم لدينا، هل تستطيعون التحقق من ذلك رجاءا؟؟ 13- We have no way to investigate this. You are better placed ! Again, the lawsuits are filed in the names of individuals, the manager of the Cooperative can only act in your name but cannot act on his own. The Kuwaitis would only negotiate against a withdrawal of the charges in Court. This cannot been done without the legal team and the approval of the victims 13- نحن لانمتلك الوسائل للتحقق من ذلك. أنتم في وضع أفضل وأقرب من وضعنا هنا في بلجيكا. مرة أخرى، إن القضية مليئة بأسماء المطالبين بتعويضاتهم، إن مدير جمعيتكم يستطيع التصرف بقضيتكم بإسمكم فقط ولايستطيع أن يتصرف بقضيتكم على عاتقه الشخصي دون الرجوع إليكم. لايمكن عمل تلك الإتفاقات التي تتحدثون عنها بدون فريق قانوني حاضر معهم. وإن حصل ذلك فعلا فإن الكويتيين سيقومون بالتفاوض في المحكمة حول سحب التهم الموجهة إليهم . ماكان يمكن لهذا أن يحدث بدون فريق قانوني حاضر معهم وبموافقة أعضاء (ضحايا) الجمعية بالإجماع. 14- It’s been a long time we have been waiting this case to finish, you are fed up as we do also. Do you think that we can win our case in your fair courts soon? What is your general expectations about it? Is it possible to accelerate the process of our case which is yours also?? 14- أننا ننتظر لهذه القضية أن تنتهي منذ وقت طويل جدا. لقد ضاق الأمر بكم وبنا. هل تعتقدون بأنه يمكننا كسب قضيتنا هذه قريبا؟ ماهو توقعكم عن ذلك؟ هل يمكن تسريع وتيرة هذه القضية التي طال أمدها والتي هي قضيتكم أيضا؟ 14- The legal way is very long and we are far from a judgment, this is why we would prefer a settlement with the Kuwaitis : a withdrawal of the charges against a compensation for the victims. No political settlement can replace this ! 14- إن الطريق أو الخيار القانوني طويل جدا وأننا بعيدون عن حكم قريب، ولهذا نحن نفضل تسوية مع الكويتيين مفادها سحب التهم الموجهة إليهم مقابل التعويض للضحايا والذين هم أعضاء جمعيتكم. ليس هناك تسوية سياسية ممكنة والتي تحدثتم عنها يمكنها الإستعاضة عن ذلك الخيار. 15- When your article to the Jordanian press will take place?? And is it possible to have you and your colleagues at Amman to present you latest and updated news related to our case and put an end for a lot of rumors? We really hope that so soon after your investigating the above mentioned. 15- متى ستقومون بنشر المقال المتعلق بقضيتنا في الصحف الأردنية الذي تحدثتم عنه مسبقا ؟ 15- We will do our best to prepare the article soon. We could talk to the general assembly and answer all questions. 15- سوف نقوم بكل مجهود لدينا لإعداد هذا المقال قريبا. يمكننا التحدث مع مجلس إدارة جمعيتكم والإجابة عن جميع الأسئلة إن أمكن. 16- Is it possible after winning our case to have some members compensations paid in your country not in Jordan for personal reasons?? 16- هل من المحتمل بعد كسب قضيتنا هذه أن يتم دفع تعويض بعض الأعضاء في الجمعية في بلادكم (بلجيكا) لأسباب شخصية؟ 16- ??? 16- لا إجابة نهائيـــاً 17- Can your esteemed company hold new cases for some Jordanian people (Not members in the cooperative society - Jordan) who were working & have been dismissed from Gulf Countries just because of the Gulf War? There are a lot of people requiring that answer very badly. هل تستطيع مجموعتكم الإستشارية رفع قضايا جديدة من نفس النوع لمواطنين أردنيين ليسوا أعضاءا في الوقت الحالي في جمعيتنا في الأردن والذين كانوا يعملون في الخليج بشكل عام وتم طردهم بسبب حرب الخليج؟ إن هناك منهم الكثير يريد الإجابة عن هذا السؤال بشغف. 17- These victims should be regrouped because we do not have the staff to work on individual cases.
