.. إليكم وثيقة الحقوق التي وضعت وصيغت سنة 1791 والتي تتألف من عشر بنود تشكل العمود الفقري للدستور الأمريكي وترجمتها : First Amendment Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. البند الأول. يحظر على مجلس الكونغرس تشريع أي قانون يؤدّي إلى دعم ممارسة أي دين ، أو تشريع أي قانون يؤدّي إلى منع ممارسة أي دين ؛ أو تشريع أي قانون يؤدّي إلى تعطيل حرية الكلام أو النشر الصحفي أو حق الناس في إقامة تجمعات سلمية أو إرسالهم عرائض إلى الحكومة تطالبها برفع الظلم. Second Amendment A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. البند الثاني إن وجود مليشيات منظمة جيدا هو ضروري لأمن الدولة الحرة، إن حق الناس في الاحتفاظ وحمل الأسلحة لن يمس. Third Amendment No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law. البند الثالث لا يمكن لأي عسكري في زمن السلم التمركز في أي منزل مدني بدون موافقة المالك وهذا أيضا ينطبق على زمن الحرب أيضا إلا بالطريقة الموصوفة في القوانين المعتمدة. Fourth Amendment The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. البند الرابع إن حق الناس بأن يكونوا بأمان بأشخاصهم، ومنازلهم، وأوراقهم، ونشاطهم، ضد التفتيش غير المعقول والاحتجاز، لن يمكن التعدي عليه، ولن يصدر أمر اتهام إلا بسبب واضح، مدعوم بقسم أو إثبات، ويصف بشكل دقيق المكان المطلوب تفتيشه، والأشخاص الذين سيتم احتجازهم، والأشياء التي سيتم مصادرتها. Fifth Amendment No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. البند الخامس لن يتم احتجاز أي شخص للاستجواب حول جريمة كبرى أو جريمة شائنة إلا بتقديم أو توجيه اتهام من هيئة المحلفين العليا ما عدا القضايا التي تبرز في الأراضي التي تديرها القوات المسلحة والسفن التي تديرها القوات البحرية أو ضمن قوات المليشيا الشعبية وذلك في وقت الخدمة الفعلية في زمن الحرب أو أوقات الخطر العام والكوارث ولا يجوز تعريض شخص لنفس المخالفة أن يتعرض إلى وضع خطر على حياته أو أحد أعضائه ولا يجوز أن يكون في أي قضية إجرامية شاهدا على نفسه ولا يجوز حرمانه من حياته أو ممتلكاته بدون محاكمة قانونية ولا يجوز مصادرة أي ممتلكات من أي مواطن للاستعمال العام بدون تعويض عادل. . Sixth Amendment In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense. البند السادس عند توجيه اتهام أو استدعاء للمحكمة لعمل إجرامي فان المتهم سوف يتمتع بحق التمكن من استعجال الإجراءات القانونية وعلنية المحاكمة التي ستجريها هيئة محلفين غير متحيزة مجموعة من الولاية والمنطقة التي تمت فيها الجريمة وتمت المصادقة على انتمائهم إلى نفس المنطقة سابقا وبشكل قانوني وابلغوا بطبيعة وسبب الاتهام ويجب مواجهته بشهود ضده وتلتزم المحكمة أيضا بإحضار شهود يشهدون لصالحه وتلتزم أيضا بتزويده بمحامي لمساعدته للدفاع عن نفسه. Seventh Amendment In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law. البند السابع في القضايا القانونية العامة حيث لا يتجاوز الضرر المختلف حوله مبلغ عشرين دولار فان حق التقاضي بحضور هيئة محلفين سوف يلغى . وأيضا إن أي حقيقة أثبتت من قبل هيئة محلفين في محكمة معينة سوف لا يعاد تفحصها من قبل أي محكمة أخرى من محاكم الولايات المتحدة إلا وفق قواعد القانون العام. Eighth Amendment Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. البند الثامن لن يمكن فرض كفالات باهظة ولا فرض غرامات باهظة ولن تطبق عقوبات غير عادية أو وحشية. Ninth Amendment The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. البند التاسع إن القرارات التطبيقية لهذا الدستور المتعلقة بالحقوق الثابتة والأساسية لا يجب إجراء تعديل فيها قد يغير أو يحطم الحقوق الأخرى المحفوظة للشعب. Tenth Amendment The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. البند العاشر إن جميع السلطات غير المنوطة بدستور الولايات المتحدة والتي هي غير محظورة على الولايات المنفردة تستطيع الولايات بنفسها الاحتفاظ بحق التمتع بها أو يحتفظ الشعب بنفسه حق الاستمتاع بها. والسؤال : هل مايمنع الإعتماد عليها حين وضع وصياغة الدستور المصري !؟ .
