Subject: Zero FIR against Akbaruddin Owaisi, MLA for his hate speeches during Maharashtra elections. Greetings, Kindly refer to the Sudershan channel bindas bol programme telecast today on October 24, 2014 and I find all hate speeches of Akbaruddin Owaisi at Nagpada Mumbai and Bhiwandi was objectionable because he is on bail in similar case. https://youtube/watch?v=BSiqIcoZ7BY Past history of Akbaruddin Owaisi, MLA: On 28 December 2012, a lawyer K. Karunasagar filed a petition in a local court in Nampally of Hyderabad against Akbaruddin Owaisi. Karunasagar asked the court to direct the police to register cases against Owaisi for hurting the sentiments of Hindus, and for making inflammatory, derogatory and offensive remarks. Karunasagar received three death threats on the night of filing the petition. Another petition was filed by a businessman S Venkatesh Goud in Hyderabad. The Andhra Pradesh Human Rights Commission directed the Hyderabad Police Commissioner to submit an inquiry report on the alleged hate speech by 17 January 2013. On January 3, 2013, the fourth Additional Chief Metropolitan Magistrate of the Nampally court directed the Andhra Pradesh Police to register an FIR against Owaisi. Following this, the police filed FIRs under three sections of the Indian Penal Code – 121 (attempting to wage war against Government of India), 153A (promoting enmity between groups) and 295A (outraging or insulting religion and religious feelings or beliefs) – against Owaisi in Hyderabad, Adilabad and Nizamabad. On 5 January 2013, a case was filed against Owaisi in Mumbai while a court in Vadodara served a notice on him for his alleged hate speech. In May 2014, Andhra Pradesh government gave nod to prosecute Akbaruddin Owaisi in a 2004 case for an alleged hate speech. After spending 40 days in prison, Akbaruddin Owaisi was granted bail on 15 February 2013. The court approved bail for Owaisi on health grounds on a bond of Rs 10,000 and two sureties, However, Owaisi will have to wait for bail in another case of hate speech in a court in Nirmal town. In both courts, his voice was recorded and sent for forensic examination”. It would be pertinent to mention here that freedom of speech does not mean to spread hate amongst society and dis respect for other religions, all hate speeches of said persons proved that he is a habitual offenders, needs to be booked under law, permanent ban may kindly be imposed on him along with disqualification from the Telangana Assembly because his all hate speeches are against the soul of Indian Constitution read with the legislation’s about Oath. Hence Zero FIR may kindly be lodged for the violation of above said offenses in Maharashtra and further may kindly be sent to the Director General of Police, Maharashtra and Commissioner of Mumbai Police. Sincerely yours, Naresh Kadian,
