- Barely a day after International Criminal Court (ICC) judges gave ICC, Chief Prosecutor, Fatou Bensouda, a directive to confirm whether she will be able to continue with President Uhuru Kenyatta’s case, the Prosecutor has thrown in the towel saying she will not be able to continue with the case. In a confidential letter she wrote to ICC judges, Bensouda admitted that the case is not likely to meet the threshold of the standards set by the ICC unless she manages to secure evidence from records on Uhuru’s wealth, including companies and land holdings. She said she had tried to look for more incriminating evidence in Uhuru’s case but for the last one year she has not gotten anything. “Hon Judges, I now admit I have no evidence to prosecute Uhuru Kenyatta. I have tried to bring Kenyatta to trial but I have been frustrated by the Kenyan Government and Kenyan media,” Bensouda wrote to the Trial Chamber V (b) judges on Friday. On Thursday, Trial Chamber V (b) judges gave Bensouda seven days to state whether she has evidence to prosecute Uhuru or they terminate the case on technical grounds.
