All, I have sought independant advice on the painting issue from lawyers/administrators running other resorts and they agree with my previous posts on how costs should be determined. Each sector, here level 2 / 3, should gain its own costs for painting, this cost should then be shared by quota between the owners in that sector. This recognises that in a resort with differing property types, penthouses, apartments and Villas that will be different costs, the Villas have a large surface area and the penthouses will require specialist scaffolding and so would have a different cost to a garden apartment. To charge all owners a single cost irrespective of their quota is against our statutes and so would require unanimous approval. Any owners that have already painted there apartments/villas should be exempt from this payment. The cost of painting any common areas should be costed seperately and the cost shared by quota between the owners in the level 2 in which this common element resides. For example there are a number of free standing electricity boxes around the resort, these are a common elements as so the cost of painting should be covered by the owners in that specific area. There are common areas within the penthouses, such as walkways, stair wells, lift areas and roof areas, these should be exclusive to the penthouse block in the same way that lift maintenance and cleaning is and so covered by the owners in each specific block. I am not against painting, indeed i believe that it is essential for the good of the resort, but it needs to be planned and costed corrected and the FULL details presented to the owners. If the above were to be implemented, which I believe to be fair and within that law and statutes, and if a quote obtained giving a reasonable price i would vote for it. For now I believe that the administration and presidents should go back and do the job properly, present a full detailed plan to the owners and then call an EGM to vote on it.
