Attorney McShane likes to deliver good news. Today, just moments ago he delivered great news to a single father of 2 who has an on the road sales job and is the sole source of income to his family. In this second offense DUI case, Attorney McShane filed an Omnibus Pretrial Motion alleging that there was insufficient probable cause to arrest this dad. His theory in the motion and in the hearing was that an officer may not simply cherry pick out certain facts, may not turn a blind eye to facts that would dispel probable cause, and must actually perform a meaningful investigation prior to arresting a motorist for DUI. No ipse dixit justifications. His happy news that he was able to give to this single dad was to tell him that the Judge after considering the facts at the hearing granted the motion. This was a total team effort. Attorney Roberts, Attorney Kennedy, Attorney Arose and Paralegal Heidi Etter were all intimately involved in this case. It was a winning case not because of the facts, but because of the hard work and framing of the issues that lead to the development of the record that could not be denied. Justice was done in this case.
