BIG SHAME THE TALE OF COUCHING, COERCING AND BRIBING ICC WITNESSES TO ACHIEVE A PRE-DETERMINED RESULT; 1. Two key witnesses (names withheld) in the case against Deputy President William Ruto, have withdrawn from the case. 2. This, for us, is a welcome setback for African house Negro Fatou Bensouda who maliciously hopes to be prosecuting the case in the coming days. 3. A former NGO employee, in the North Rift during the 2007-2008 post-election violence (PEV), identified as witness Number K0336 has filed an affidavit seeking to withdraw 4. A former KASS FM employee have filed affidavits and other documents with the ICC’s Office of the Prosecutor (OTP), Registry, Office of the Counsel for Defence and Office of the Counsel for Victims seeking to withdraw as witnesses in the case that “is scheduled to begin on September 10, 2013.” 5. Eldoret-based lawyer Christopher Mitei of Arap Mitei and Company Advocates communicated their decision to the ICC in a letter dated August 30, 2013. 6. The first witness identifies himself as a male resident of Elgeyo-Marakwet County and a former KASS FM employee until 2008, when he was sacked. He believes he was dismissed at Joshua arap Sang’s instigation. 7. The witness says in October 2012, he was approached by an ICC investigator identified as Paulo to be a witness at the ICC, “by virtue of having worked at KASS FM between 2005 and 2008.” and agreed to testify. 8. However, he says at the time he accepted to participate in the process, he was not in the mindset to make rational decisions because his mother had just died. 9. He said he was in the process of divorcing his wife and had also been admitted to hospital. 20. The witness says the situation has changed because his father is distressed and has attempted to commit suicide because of his decision to be a witness while his siblings and children are opposed to his participation in the case. 11. “I hereby notify your office that I have withdrawn as a witness against the accused persons (RUTO/SANG). 12. My father is distressed, sickly and is contemplating suicide. My siblings and children are extremely anxious… 13. My participation in the process has caused my family immense mental and emotional suffering… at the time of accepting to participate I was under intense mental turmoil… 14. My participation has drawn extreme resistance from my family members and I am greatly anguished at their condition… 15. My continued participation in the process will cause continued mental anguish and adversely affect my family’s well-being. My participation has caused my family (untold) agony… 16. I have looked at the tranquility currently prevailing in Kenya and I don’t want to contribute to a situation which may disturb the peace that Kenyans are currently enjoying… 17. Owing to the issues aforesaid, I do not wish to participate in the process. I am not in the right state of mind to go on… 18. I, therefore, swear this affidavit to confirm that I have withdrawn my testimony in its entirety and will not participate in the process any further, 20.” the witness says in a sworn affidavit. Incredible stuff! Well done, 21. The second witness, Number K0336 from Uasin Gishu County, says he has chosen to withdraw because he is appalled by the inclusion, in the case, of an NGO (read AFRICOG) and other individuals (read Gladwell Otieno & Co.) with political affiliations. 22. He says he helped identify witnesses during his work as a Kenya National Commission on Human Rights (KNCHR) social worker who worked with IDPs and his statements were passed on to ICC 23. The witness says he has since lost confidence in the court and has relocated from his hideout in a neighbouring country. 24. He says he has, further, asked his family to leave the safe-house allocated to them in Nairobi by the ICC 25. “I, the above named (K0336), do hereby wish to withdraw from the above referred process, which was a voluntary one. 26. I was involved in introducing other witnesses to the ICC and this has had a negative impact on me as a person and to my dignity as a social worker, putting my life in danger… 27. Based on my personal survey, it is evident that the victims and those perceived to be against the community have reconciled (read the protagonists have reconciled) and now Kenya is a stable country. 28. I want to contribute in making Kenya even more stable… 29. I do not understand how and why AFRICOG, Gladwell Otieno and other third parties are participants in a case I have been requested to testify in or in what capacity the Chief Prosecutor invited and/or involved them in the case… 30. I do not wish to be associated with the above individuals and I do not wish my name to be tarnished… 31. I have seen and felt the agony and trauma that my family has been going through since they learnt that I was a witness in this case and wish to lift the burden from my back… 32. Based on the above, I have decided to withdraw myself willingly from the process and I have gone back to my country… 33. I have also asked my family to vacate the safe house allocated to them in Nairobi by the ICC. I have no intention to go back to the process… 34. I deeply regret having agreed to take part in the process. The source of my regret is that while I thought I was dealing with the prosecutor and that they were acting in good faith in search of justice for the post-election victims, 35. ALL things turned upside down for me and my family when I was persuaded to leave this country and promised protection in a neighbouring country… 36. I, therefore, swear this affidavit out of my own volition on this 29th day of August 2013 to confirm the reasons contained in my letter of withdrawal and in this affidavit,” 36. The witness (Number K0336) names former KNCHR commissioner Hassan Omar Hassan, who is currently the Senator, Mombasa County, Ken Wafula of the Centre for Human Rights and Democracy and George Bett of the Anti-Torture Campaign as some of the people who identified and assisted potential ICC witnesses..
