Background checks expanding for home-healthcare workers; consequences for estate planning? Navigating the process to secure reliable and safe home-based health care services for the elderly, infirmed and disabled can be difficult, and may be getting harder in Michigan. For good reason. State officials recently pledged to implement background checks and preventative measures to keep some felons from providing in-home care to Medicaid recipients after an audit uncovered more than 3,800 convicts working in the system. The scathing 81-page review by the Michigan Office of the Auditor General concluded that the efforts by the Department of Community Health and Department of Human Services were ineffective in staying consistent with current law and administrative policies. Further, the audit confirmed roughly $160 million in improper payments related to health care services, and identified several areas of concern that could result in fines and sanctions for non-compliance with federal law.
