Canadian Immigration Updates and News Our efforts to keep you informed are ongoing. Lately, changes have been frequent and we wish to keep you up to date. Today, we are providing details of the significant changes to the Labour Market Opinion Application (LMO) processing that is overseen by the Government of Canada. Changes Including - Introduction of Processing Fees; Language Restrictions; New Advertising Requirements; Questions Concerning Labour Market Impact Fees for Labour Market Opinion Processing Effective July 31, 2013, employers filing applications for LMOs will be required to pay a fee of $275.00 for each position requested. The fee must be provided along with the application. These fees cannot be recovered from the temporary foreign worker. Language Requirements In conjunction with amendments to the Immigration and Refugee Protection Regulations, English and French are the only languages that can be identified as a job requirement in both the LMO application and the advertisement for the position, unless the employer can demonstrate that another language is essential and provide justification and rationale for same. New Advertising Requirements Employers are required to demonstrate far greater efforts to hire Canadians before filing for an LMO. The new advertising period is 4 weeks. Advertisements will need to be posted on the National Job Bank, in addition to at least two other recruitment methods that are consistent with the normal practice for the occupation and the advertisement must remain posted until the LMO is issued. The records of the advertising must be kept for a minimum of 6 years. Questions Concerning Labour Market Impact The LMO Application now includes detailed questions specifically addressing the impact that the temporary foreign worker will have on the Canadian labour market. In certain cases, a supplemental form on this point will also be necessary.
