Chepkwony takes war with MCAs to court Kericho Governor Paul Chepkwony has moved to court to seek an interpretation of roles of the county executive and the county assembly. This follows a long standing conflict that has paralysed operations of the county. The governor is also seeking orders to suspend motions passed by the assembly stopping the county Public Service Board from recruiting 30 ward administrators and distribution of 750 Early Childhood Development Education teachers among the 30 wards. In the petition filed under a certificate of urgency by lawyer Peter Wanyama, Chepkwony also wants orders stopping the assembly from barring the executive from implementing a bursary scheme for needy children. Speaker Japheth Mutai the county assembly have been sued as the first and second respondents. The assembly, in a motion dated February 20, urged the board to stop the recruitment of ward administrators until the board avails to the assembly the criteria used in short listing prospective candidates for the posts. The respondents in another motion dated March 5 sought a vote on the distribution of ECDE teachers among the 30 wards. In another motion dated March 12, the assembly stopped the department of Early Childhood Educational and Vocational Training from issuing and distributing bursary forms to needy students on grounds that proper guidelines for the process had not been put in place. “The motions contravene Article 179 (1) of the constitution, which provides the executive authority of the county in a county executive committee,” reads Chepkwonys application filed at the High Court in Kericho. Justice Hellen Omondi of the High Court in Nakuru yesterday certified the application as urgent and directed that it be served on the respondents for inter parties hearing before Kericho resident judge Joseph Sergon today.
