ANIMAL CARE CENTER Landlord/ affiliates of landlord are the DE CEUSTER family ( Virginie and Julie), ANIMAL CARE CENTRE and Newros Ltd, ( Anguilla Company) The landlords keep putting off responsibilities and blame one another for the reasons of poor conditions. This has been going around for 7+ years.. Basic Building Maintenance, and sanitary matters are severely neglected.. There are 4 residential apartments in the building., The tenants have been complaining individually to deaf ears. All the tenants wrote a letter and all signed it. The response from the landlord is also worth reading! LETTER TO LANDLORD FROM TENANTS SIGNED BY ALL TENANTS, DELIVERED AND RECEIVED AT ANIMAL CARE CENTRE ON 12 JUNE 2014 (Surnames of Tenants and Signatures blocked here for Privacy protection) Original documents are available for inspection in order to support authenticity. All Tenants Residing Zozo Moran Drive 18 Cole Bay Sint Maarten 08 June 2014 Dear Julie DE CEUSTER, We are writing to you in protest due to maintenance issues of the building and property from which we rent from you. The matters are concerning the exterior of the building and property and in some cases interior of our apartments. We have on several occasions brought certain matters to your attention separately. You responded to us individually that you will correct these issues which are as followed, but so far we have not seen any results: EXTERIOR 1. Driveway and parking area grounds needs to be graded smoothly; a. Deep pot holes which has had negative outcomes. Our cars have and continue to be damaged because our cars are scraping the ground due to the severe unlevelled surface. This has caused some of us damage to our cars and has cost us lots of money for repairs. b. Water collects in these large holes causing puddles which allow breeding of mosquitoes. 2. The building exterior walls and roof are currently grey which absorbs the heat from the sun making the interior of our apartments extremely hot and very uncomfortable to live in. a. A logical solution is that the exterior and roof must be painted in a light colour such as white. 3. The grounds are polluted by deification from the dogs by the veterinary clinic downstairs. This, is a health hazard bringing flies and terrible odour to our homes. Some times it is so upsetting because we step in shit especially in the night and going in and out of our cars. Sometimes that clinic doesnt wash the drainage ditch next to the dog cages daily. The smell is horrible for all of us, especially Apt 4. a. It should be the responsibility of the clinic to pick up after the dogs immediately and instruct their clients to do the same. b. We recommend that the clinic provide a rubbish bin, display a sign asking people to clean up after their dogs, a shovel and plastic bags, in order for people to clean up after their dogs. 4. The section of parking that is paved with the bricks, where we place our cars, needs to be cleaned from the mud and debris with a shovel. In some spots, it is not even possible to see the bricks any more. The gardeners never do this! 5. It is the responsibility of the landlord to keep the common areas clean. Since this was not done so in the past, we the tenants have taken turns to wash the stairs and terraces and in some cases the drainage ditch near the dog cages, at times when the clinic left it dirty, weekly, on our own. However, in recent months, the water faucets have been locked no longer allowing us to do the job which is your responsibility. 6. The security bars for the windows and doors are rusty and are looking very bad. They need to be painted. 7. The veterinary clinic leaves garbage bags remaining under the stairs instead of placing them in the rubbish bins provided by the municipality. It smells bad and is an eye sore. The rubbish needs to be disposed of properly. The clinic is only open during business hours. We the tenants have to live with this all the days and nights. 8. The terrace to the entrances to our apartments need to be tiled. The existing cement surface is falling apart and becomes dust which blows into our apartments, which requires us to be cleaning regularly due to the problem. 9. The premises needs pest control from time to time. This applies to the upstairs as well as the downstairs and grounds. Per a conversation with Ariel WEISS of Apt 1, you have told him by corresponding and discussions, in December 2013, that you would have the house painted in 5 months. It has already been 6 months. INTERIOR 1. Apt 2 has the following issues that need corrections a. It is not possible to open and close the windows in the salon properly. b. The floor in the bath room has an area where the floor is very hot. The floor in a section of the salon is also very warm. It seems like there is an electrical short under the floor. c. The job of the window replacement in the bedroom has never been completed with regards to the masonry of the wall. d. The bathroom still has live electrical wires protruding from the wall. One can hear the sparks of the static electricity. e. There seems to be a hole in the wall of the salon near the ceiling. Bats that had entered the apartment and were living inside the house. It was very frightening! 2. Apt 4 and Apt 1 need closet doors in the bedroom, 3. The kitchen sink in Apt 1 which has recently been replaced is leaking. We would appreciate your fast attention and a resolution to all these matters soonest. Being told to wait months for your actions and waiting indefinitely with no results is not an option for us anymore. We think it is fair to say that we are good tenants and we deserve these basic needs. We expect to receive an acknowledgement and resolution letter from you to all of us in writing with in a week of your receipt of this letter. Regards. Signed by all tenants. Cordialy, julie. me 19:38 Julie, since all of us tenants wrote to you collectively, it is only appropriate for you and us to continue to communicate the same manner which we will do. However to quickly address your ruthless response,We are not paying low rent as you say. We are paying higher or just about market prices. Perhaps you can check in our own street and find out that we are paying more than others on our street. And even then, their land lords treat their tenants like human beings and do not permit their tenants to live in less than standard conditions. We have been tenants here for many years. The least you can do is show that you care even though you dont. With regards to the car, I have two cars. most appartments always had two cars. Your sister told me about another car when I was holding a third car for one month in December for a friend. She asked me to move it and I did. At least I have paid my rent. When Roy was here and did not pay rent for many months and had three cars or more sometimes, that belonged to his family, that was ok? If I had a partner living with me that person would also be entitled to have a car just like the rest of the tenants have been doing all the years in your building. We have clearly stated in our letter to you all the problems here and most are quite easily fixable and doesnt cost so much money. I know the value and costs to do these things. Prior to my return, I was expecting to find that the things we discussed with the house to be in the works or at least in the commencing stage. Per our corresponding and discoussions, in December, you said you would have tbe house painted in 5 months. Also, the driveway is in terrible condition and needs to be graded smoothly. The mufler of my Bmw has finally broke, months ago due to it smashing to the drive way holes and bumps so many times. I already replaced the steering system two times because of this also. I know that others have also complained to you about this. Now it is hot again and it is like an oven in the house. The house needs to be paainted and the roof also, just like the neighbours have done. I ha e alrsady had two bad headaches from the heat in here. I would appreciate for you to kindly get on top of this soonest. Finally, I still need closet doors for my bedroom. I have been waiting years for it. As you recall, I shopped around and priced them at a little over $200 us. I think I can even install them myself. Please let me know on all the above matters.
