Comelec urged to make sure that Smartmatic owns the voting machines it is offering in the bidding An international service provider has asked the Commission on Elections-Bids and Awards Committee (Comelec-BAC) to make sure that Smartmatic -Total Information Management (TIM) owns the Optical Mark Reader (OMR) it is offering in the bidding for the lease of voting machines for the 2016 polls. In a two-page letter, Indra Sistemas S.A. lead counsel Archivald De Mata expressed concern over the possibility of the 2013 controversy might happen again in the next national polls. “The BAC should be advised or informed whether Smartmatic joint venture or any member thereof owns and/or has developed the (OMR) machines that it intends to provide to this Honorable Commission. We respectfully submit that this may be done only through a categorical confirmation from Smartmatic,” he said. The lawyer added, “We deem such confirmation of utmost importance to avoid any violations of the provisions in the bidding documents as what previously happened.” The 2013 midterm election was marred with controversy involving the legal battle between Smartmatic-Total Information Management (TIM) Corporation and Dominion Voting Systems. It was recalled that the refusal of Dominion, which owns the PCOS software, to have the source code released by Smartmatic and the Comelec, as required by law, almost prevented the commission from holding the elections. The source code was only released two days before Election Day. “We, at Indra, are apprehensive that there will be a repetition of the events that occurred, specifically a dispute between Smartmatic and the licensor of the software during the 2013 elections,” De Mata said. Indra and Smartmatic-TIM are bidding for the lease of voting units to supplement the old Precinct Count Optical Scan (PCOS) machines to be used in the 2016 elections.
