Date: 8/8/2013 To Whom this may concern RE: Unlawful Imprisonment; Fraud; Gross Neglect; Forgery; Malfeasance; Official / Judicial Misconduct; Nepotism; Violation of the US Constitution; Violation of the KY Constitution; Violation of CR 61; and Violation of KRS 26A.080. Greetings; I would first ask you to pardon my intrusion on your time, as I understand you are busy. On a first note and as an introduction, I am Bennie L Gamble, Jr and am currently unlawfully, unconstitutionally and illegally imprisoned at the Northpoint Training Center in Burgin, Kentucky. This has come about by the judicial misconduct by a Judge of the McCracken County, KY Circuit Court pursuant to a void judgment (Case # 97-CR-00291). The judgment is void of law as it was reversed and remanded by the Kentucky Supreme Court Case # 1999-SC-0567-MR). The McCracken Circuit Court is want of jurisdiction over the subject matter, the person of myself and to even enter the judgment in the first place, pursuant to CR-61. The Kentucky Supreme Court found that substantial error has occurred and that is why they overturned my case. However to date I am still imprisoned and that imprisonment has yet to be corrected, as I have attempted through all proper means to affect my release to no avail. Therefore I must seek the assistance of others in order to perfect my release, through this letter to you. It has been proven that a natural right to and unrestricted enjoyment of life, liberty and happiness. By nature all people are equal with any other person or group of persons and has the natural power, not only to preserve his property, but his life, liberty and estate. We are bound by nature to guard against the attempts of others, who would cause us injury and harm, as well as to judge and punish those who would violate the law as one is persuaded the offense deserves. This punishment could rise to the death of an individual if heinousness of the crime is such in the opinion of those who so judge feel is deserved. As usurpation is the exercise of power which another has a right to, as tyranny is the exercise of power beyond right, of which no one should ever have a right to. This is making use of power anyone has in his hands, not for the good of those under it, but for his own private advantage- when the executive officer makes not the law, but his will, the rule, and his commands and actions are not directed to preservation of the properties of his people, but the satisfaction of his own ambition, revenged, greed or any other “unlawful” passion…. “Whenever law ends, tyranny begins,” if the law be violated to another’s harm and “whosoever” in authority exceeds the power given him by law, and makes use by force invades the right of another. This is acknowledged in minor officials (empowered to make an arrest). He who has the authority to seize my person in the street maybe opposed as a thief and a robber if he endeavors to break into my house to serve a warrant, notwithstanding that I know he has such a warrant and such a legal authority as will empower him to arrest me in the streets. Why should this not hold the highest as well as in the lowest officials? I would be gladly informed. It is reasonable that the oldest brother, because he has the greatest part of his father’s estate, should thereby have a right to take away any of his younger brother’s portion? - Or that a rich man who possessed a whole country should have a right to seize when he pleased, the cottage and garden of his poor neighbor? - Having great powers and riches…. Can be NO excuse or reason for his plunder and oppression- Exceeding the bounds of authority is no more right in the greater than in a petty officer, no more justifiable than in a king than a constable, and is “so much” the worse in him, because he has more trust put in him- has already a much greater share than his fellow citizen and is supposed, form the advantages, of his education, work and advisers, to be more knowing in matters of “right and wrong”.
