Evaluations on the stun-gun show it operated properly at the time of the shooting. The internal data-card identified the date and time of the shooting as well as the length of time of the shot. The data-card revealed Harris held the trigger in excess the five-second cycle allowed for stun-gun blasts of 50,000 volts. Both the excessive stun-gun blast, and the head shot, violate department policies as does the fact that Ryan Wilson was not resisting arrest or combative. As Harris testified in deposition, “On August 4th, 2006, the primary level for utilizing a stun-gun would be an Active Aggression. When I pulled the stun-gun out of my holster... Ryan would have been at Defensive Resistance. Correct, without the knife, no. I would not be allowed to use the stun-gun for the Defensive Resistance of running away.” Ryan was unarmed.
