FEE HIKE This is with reference to the Maharashtra Educational Institutions (Regulation of Collection of Fee) Act, 2011, there is a provision that the Fee Structure of all students will be determined / decided by the PTA Executive Committee consisting of 13 members (one from each class from Nursery till Std. X). After going through the provisions of the said Act and various judgement we came to the conclusion that the Government can not delegate it powers to any other authority / individuals / association. The very important aspect is that the said PTA Executive Committee is incompetent, inexperienced, no knowledge of the subject to decide fee and moreover it is not a Statutory Body which can be held responsible for any misdeeds as there is no provision in the Act where penal action can be initiated on the committee if there is any manipulation. This committee is consisting of Pre-primary, Primary and Secondary parents, which will decide the fee structure of almost thousands of students studying in a school. Further, the committee will be selected by Lottery System, which is non-transparent and can be easily manipulated by the school management, as is being happening. The latest case is JBCN School where it was alleged that there was no transparency and the result were manipulated by the school. The most important factor is that if the school management does not want a particular parent to win the election through lottery system, they will ask more than 50 other parents, favoring the school, to put their lottery also against a particular unwanted parent, this will reduce the probability of that one unwanted parents to be selected , in short the probability will be 1:50 and thereby giving better chance of winning to any other parent sponsored by the school. The very system itself is against the HIGH COURT Order of 1998 in which clearly states that the PTA Executive Committee must be Elected Democratically. It amounts to Contempt of Court also. The executive committee selected through Lottery system will have no knowledge of the subject, current laws, Acts, Rules and Regulations, reading the Audited Accounts and Balance Sheet etc. Do the parents know what is legal fees and what is illegal fees? Do they know the law? Do they know what is Admissible Expense and What are non-admissible expenses? In short, hardly 1% of the total numbers of parents in the school will be competent to understand the Accounts and other related matters. How can the other thousands of parents rely upon those who are not competent enough to decide the fee structure? It is the duty of the Government to either appoint a Statutory Authority or the Competent authority to decide the Fee structure on un-aided private schools. The Govt. can not delegate it powers to any other incompetent and unqualified body or a group of people. We strongly protest against the said provision of the Act and will certainly would like to challenge it in the Court of Law if the Government fails to amend it. Let the Government decide the Fee Structure of un-aided schools.
