FOR THE RECORD! KATHARINA VON ROTHENSANDE / KRISCHAK v THE REST OF THE WORLD You may have seen over the past week that Katharina Von Rothensande of Rothensande Shetland Pony Stud in Germany has had lots to say about many people on Facebook. Interestingly and very disappointingly she has spread numerous lies about us at Sandbeck Farm. We therefore would like to set the record straight as she seems insistent in causing trouble for me and my family declaring we have committed fraud on a regular basis against her! The simple truth. On the 25 June 2014, Ms Krischak contacted me via our website to make enquires about a Birling pony we had here on the farm and had retired a couple of years previously. We politely told her that a pony of 20 years old was not suitable for breeding but she insisted on buying her. Having no previous dealings or prior knowledge of Ms Krischak, we agreed to sell (Mistake number one) She promptly paid and I sent her pictures of the pony and as with all our ponies she was prepared (i.e. feet trimmed, wormed and health checked) and ready to go. She arranged for her transporter to collect and transport to Germany. We thought this to be a happy conclusion for one of our well loved mares, sadly, we were wrong! The very next day, she bombarded me with emails, begging for me to help her purchase ponies in the UK, as nobody liked her and there was a Shetland ‘Mafia’ out to make her life hell! Whilst we had briefly seen the occasional comment on facebook, we didn’t really take much notice of her behaviour and said we would make some calls for her. (Mistake number 2) you get the idea! Very promptly she sent through a total of 32 ponies names for me to secure for her and gave all the contact numbers and email addresses in order to complete this task. I told her that whilst we were happy to help anybody she couldn’t expect us to do this for nothing and I told her that we would look to purchase these ponies and sell them back to her for a small profit. This came with many conditions and we were sworn to secrecy and never to mention her name in any of the dealings along with demands on change of ownership made out completely before the ponies leave the UK! With this we made several telephone calls and were able to purchase 6 of the 32 ponies that we agreed to sell to her and most of the people knew of Ms Krischak and wouldn’t sell their ponies unless we agreed they wouldn’t be sent to her. These ponies were never purchased as we would never do this but the 6 were happy to proceed. This took 3 months to achieve and as you can imagine a tremendous amount of phone calls and over 300 emails. On each and every purchase Ms Krischak agreed the purchase price. Sadly this time the payment for them was not forthcoming and now all the previous warnings gave rise to great concern. We received many calls and emails from people telling us not to deal with her as it would end badly, however, by this time we were too financially involved so had to continue. All the ponies were collected by her transporter Stephen Gardner, who has also been accused of many things on facebook. I was able to speak to Stephen and he agreed that he would not send the ponies until I received payment. As you can imagine when I told her this she wasn’t very pleasant and demanded that she paid for the ponies once they had reached her in Germany. She also told Stephen that she would only pay him when she received the ponies. We found it strange that her behaviour was so aggressive when it was Stephen that held both ponies and passports. I understand he was paid 90% of the transport prior to them leaving the UK. He had also driven up and down the country collecting these ponies for her and held them on free livery at his farm whilst she bought other ponies! She agreed that she would pay for the ponies via Paypal leaving a balance of £1000. At the time I thought it strange because she had made the first payment directly into our bank account but insisted this time around, she needed to pay via Paypal. It showed up in our PayPal account and we were happy that we had a written agreement she would make payment of the balance when the ponies arrived in Germany. They finally got to Germany with all passports present and transferred over to her name, apart from one, which I made sure was still in my name as we were still owed the balance. Within 5 minutes of Stephen texting me the ponies had arrived safety and she was happy with them, I received an email from PayPal stating that Ms Von Rothensande had disputed the payment and wanted it all back. Thankfully 30 days had passed and she was unable to have the money put back into her account! We now knew we had been duped and had she made the transfer a day later she would have managed to keep the payment for the ponies. She sent through an email stating she wasn’t going to make a payment and she would take us to court for FRAUD and win because she has previously. As you can imagine we were in total disbelief and did not know what to do. She now claimed that she was not prepared to pay the purchase price previously agreed. Despite the cost of every pony being agreed before I purchased them to which I have her agreement documented. A lesson well and truly learnt! We gave her 7 days to make the final payment which she failed to do. Ms Krischak then began contacting my friends and family via facebook, asking them to get involved to stop me asking for the final payment as she had no money! I emailed her requesting she stop harassing my friends and family and gave her a further 7 days to make payment for the remaining balance which she also failed to do. In the meantime I received the passport back from Stephen knowing what she had done. I remain in possession of the ownership and passport of this mare and have informed Ms Krischak that unless the final balance is paid she will not achieve ownership or the passport. The SPSBS have been informed of the details and they have confirmed that ownership will not be changed unless I have agreed. Disappointingly I discovered that this is not the first time this has happened and an email received from the SPSBS indicates that Ms Krischak has her own department at the SPSBS office and all matters relating to her are only dealt with by Claire, the Office Manager! We are now faced with no option but to take Ms Katharina Krischak to court to secure the final payment which is fortunately very well documented in correspondence. We therefore believe she will be dealt with appropriately by the court. We have been left with the unfortunate attack through facebook and as the majority of you are aware, her posts are nothing more than trouble causing and slander. It is great to receive so many emails and messages from people we have never even met with encouragement and support, the opposite of which can be said for Katharina as within the last week, she has only managed to achieve 2 ‘likes’ on her page regarding these malicious lies. Her claim that she has contacted the previous owners of the ponies and they are in full support of her is simply untrue (if this were to be true she would have dealt with them directly in the beginning). I have direct contact and support and they have also informed the SPSBS that the ponies should be in my ownership until paid. With regard to Stephen, I have no previous relationship with him and have still never met him and her claims about him are also untrue. Therefore, we would really appreciate it if people could like this status to show Ms Krischak and anybody that is stupid enough to believe her lies that she is the vile, vindictive person in all this. We have asked the SPSBS to revoke her membership to the society and we believe that this will be the case next year. We are also delighted to see that 99% of her posts have been deleted within minutes of them going on and by people that know what this malicious women is capable of. We have also been informed that she is being taken to court in her own country for similar activity, this is nothing more than criminal intent to deceive and should be punished through judiciary system. Anybody that knows Louise and me know that we not the people she has described and if anything, we were naive to think that we could help her. I would encourage everybody to delete her as a friend and delete all her horrible posts of the pages you have access to. We will not comment any further on this through facebook opting to let the court decide her fate. Thank you again for the huge amount of support and please help to remove this vindictive and premeditated parasite from facebook and remove her from SPSBS membership.
