Friday, December 12, 2014 Due to the now released report on torture carried out by members of the CIA I have felt it prudent that reference be made to specific articles in UNCAT (United Nations Convention against Torture) First and foremost acts of torture are strictly prohibited and all member states are expected to adhere strictly to the noted UNCAT. As there has been a growing awareness, there has been third party countries utilized by the CIA in which to violate law. The British government assisted rendition flights as have representatives of the security services, otherwise known as Mi5 and Mi6, this evidences complicity in the aforementioned acts of torture. Further evidence may be effected by scrutiny of the extensive acts of Home Secretary Theresa May and others to ensure much detail had been redacted from said report. Beyond Britains complicity in enabling acts of torture is that there are 9 ( nine ) entities / countries known to have hosted secret CIA prisons, those being: Afghanistan, Bosnia & Herzegovina, Guantanamo Bay, Iraq, Lithuania, Morocco, Poland, Romania and Thailand. Furthermore the following countries facilitated CIA led torture: Albania, Algeria, Australia, Austria, Azerbaijan, Belgium, Canada, Croatia, Cyprus, Czech Republic, Denmark, Djibouti, Egypt, Ethiopia, Finland, Gambia, Georgia, Germany, Greece, Hong Kong, Iceland, Indonesia, Iran, Ireland, Italy, Jordan, Kenya, Libya, Macedonia, Malawi, Malaysia, Mauritani, Pakistan, Portugal, Saudi Arabia, Somalia, South Africa, Spain, Sri Lanka, Sweden, Syria, Turkey, United Arab Emirates ( UAE ), United Kingdom, Uzbekistan, Yemen and Zimbabwe. Given that a substantial number of the above listed countries are signatories and / or have ratified the United Nations Convention against Torture ( UNCAT ), they have engaged in unlawful behaviour that is as mentioned prohibited. There is an obligation that all concerned countries be held accountable for engaging in, assisting and or enabling acts of torture by the CIA as well as being otherwise complicit in such acts. Ar this present time there must be adherence to internationally recognized law in that those government representatives that permitted acts of torture to take place in their respective countries contrary to Section 2, paragraph 1 be held accountable. Having held knowledge of torture taking place, permitting such to continue, having taken no measures to impede upon such acts as torture or indeed to find the cessation of such is complicity in the act ( of torture ). The above noted entities also facilitated and enabled rendition flights which themselves transported detainees to establishments to be placed under unwarrantable duress with acts contrary to those laid out in UNCAT. Persons that engaged in the unjust removal of persons to be placed on rendition flights carried out acts of kidnap which again enabled torture. Article 2: 1: Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction. 2: No exceptional circumstances whatsoever, whether a state of war or a threat or war, internal political instability or any other public emergency, may be invoked as a justification of torture. 3: An order from a superior officer or a public authority may not be invoked as a justification of torture. Article 4: 1: Each State Party shall ensure that all acts of torture are offences under its criminal law. The same shall apply to an attempt to commit torture and to an act by any person which constitutes complicity or participation in torture. Article 5 1: Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences referred to in article 4 in the following cases: 1: When the offences are committed in any territory under its jurisdiction or on board a ship or aircraft registered in that State; 2: When the alleged offender is a national of that State; 3: When the victim was a national of that State if that State considers it appropriate. 2: Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over such offences in cases where the alleged offender is present in any territory under its jurisdiction and it does not extradite him pursuant to article 8 to any of the States mentioned in Paragraph 1 of this article. 2: This Convention does not exclude any criminal jurisdiction exercised in accordance with internal law. The United Kingdom signed UNCAT 15 March 1985 and ratified this convention on 8 December 1988 Persons such as Tony Blair former British Prime Minister, Jack Straw the shadow deputy Prime Minister of the United Kingdom and former home secretary, Theresa May Home Secretary and other as yet unspecified persons have been involved with the enabling, facilitating and otherwise assisting unlawful rendition flights and acts of said torture. Police authorities are obliged to arrest and detain all persons known to have held involvement with acts of torture as described above although not reserved to those listed matters. To clarify: there is no leeway nor should any be given in relation to persons involved or having been complicit in the acts of torture, whether tjis be a past or indeed present member of parliament or representative other of a recognized body. The ongoing attempts by Theresa May to cover up the home office involvements with rendition flights and acts of torture is unacceptable and further evidences her recognition of overlapping implications for bother her and a substantial number of her subordinates. Refusal to comply by members of the police authority to enforce the detention of all involved parties with immediate effect will present a lack of willingness to carry out their expected duties in upholding due process, and rule of law, further compounded by the abject denial of justice. Police officers are not to enter discussions with parties concerned in the acts of torture or having been complicit in such acts prior to the arrest and detention of those persons to be held for formal interview with legal representation present for each individual detained. Persons that have perpetrated acts of, or that have been complicit in the acts of torture carried out by members of the CIA known to be overseas at this time to also be arrested and detained and where able the extradition process of such persons be enacted to ensure full and prompt investigations by the relevant law enforcement officials. A standing ( current ) member of the British parliamentary infrastructure is not absolved of blame in acts of torture due to their position. My above composition may be considered as a point of reference, holding understanding of being my initial presentation for formal complaint in relation to the clear violations of internationally accepted human rights and humanitarian law by members of the CIA and others in relation to acts of torture and complicity in those acts. Matters addressed above may be further expanded in light of further scrutiny of the overarching concerns and should not deemed as restricted only to that which I have entered above.
