She quotes a Facebook post from me, which I later included in a column, where I assert that the liability paragraph in the DAP decision is likely a last minute insertion (a conclusion I make based on textual analysis) and is orbiter. For the first time, as far as I know, we find out why the Chief Justice objected to the nomination of the Solicitor General for the vacant Associate Justice position (its interesting that the CJ is allied on this with Senior Justice Antonio Carpio, as they were supposed to be not in good terms as a result of his being bypassed) with the charge being very serious indeed (a matter of patriotism, related to the China arbitration case). Definitely I agree with these exhortations from Glenda: A president equipped with the big picture and blessed with good memory would rise above it and use a more sophisticated approach to the standoff. That was a basic expectation for someone who enjoyed tremendous public support when he whipped the judiciary and used executive and legislative power to cut off its head. The basic assumption is that such tools are to be seldom used – if at all . . . This is becoming an unwieldy court as far as youre concerned. You have the right to think you deserved better because of the great risks you took to reform it. But this Supreme Court probably has the right, too, to think they deserved better precisely for the same reasons. Mr President, cut it some slack.
