Governor Rick Perry has been indicted by a Travis County Grand Jury on two counts. Count 1 – abuse of official capacity. Count 2 – coercion of a public servant We have multiple crews at the Travis County Justice Complex and at the Travis County Jail. Coercion of a public servant “A person commits this offense if he … influences or attempts to influence a public servant in a specific exercise of his official power or a specific performance of his official duty or influence, or attempts to influence a public servant to violate the public servant’s known legal duty.” Class A misdemeanor Punishable by up to up to a year in jail and a $4,000 fine Abuse of official capacity “A person commits this offense if, with the intent to obtain a benefit or with the intent to harm or defraud another… he misuses government property, services, personnel or any other thing of value belonging to the government that has come into the public servant’s custody or possession by virtue of the public servant’s office or employment.” Class A misdemeanor Punishable by up to a year in jail and a $4,000 fine
