Hiding behind court order does not help you rebuilt your credit to the citizens. Not to mention that the police has overstep from the area that the original order covers and to do a one-time cleaning. It only help further bankrupting the credit of the whole regime. By its neutrality, the judicial branch has been the last frontier to civil liberty in HK, even when there were the controversial decisions regarding several immigration cases . Sadly, it may change today. It would make the society have less trust to the court than before. Itd make the courts decision to be viewed political but not legal. Surely, it was a smart political move. The police knew that their credit has been shaken in September.28th action. So they waited. For more than a month. They know by the protocol of people who believes in civil disobedience, courts decision shall be respected, because they know theres a serious price to society not having a widely-trusted body to protect them . So they seek chances, just like this time, private citizens suiting the protesters. So the court could come in, followed by armed police, with greater justification. There is something in common between this case and Ferguson procescution. In Ferguson, police feared people questioning the investigation. So they applied for the court to use Grand Jury to decide whether theres a ground to put charge. Using the force of the third party (people; court), were both smart political decisions but theres always consequences to play politics. Sometimes its short term (chain protests and riots in US) and even worse, there would be long term harm like distrust to the regime as a whole.
