IMMIGRATION UPDATE: GREAT NEWS FOR PERMANENT RESIDENTS AND THEIR SPOUSES AND CHILDREN If you have a green card, and your spouse (and/or children under 21 years old) are lawfully present in the U.S., they should get ready to file their green card application in August 2013. The Visa Bulletin, which normally shows 2 years waiting period for F2A category, is going to be current during next month. It is going to be open at least a month; this is why it is important to file the necessary applications during August. If the I-130 immigrant petition is filed and pending, they can apply for their green card. If you have not filed anything for them, you can prepare all the necessary applications and file in August. Even if the category were to retrogress (meaning the priority dates change), the spouse and children will be able to remain in the U.S. together while the green card applications are pending. In approximately 90 days, they will receive work and travel permits which will allow them to get apply for a Social Security Number and Driver License. If you were waiting to naturalize before you sponsored them for green cards, you can apply for them now without waiting. Sponsor them in August, or marry your boyfriend or girlfriend in July, and get the paperwork ready to file in August. This update is about the people in the following situation: - You have a green card, - Your wife and/or children under 21 years of age is in legal status in the U.S., - If you are planning to get married with your boyfriend or girlfriend who is in the U.S. under legal status, you can start the green card process for them during the next month.
