In High Court no reservation on caste basis but only on merits is the one claimed by many but my question is this: In Lower Judicial Service Advocates are appointed as Magistrates/Munsifs on caste basis and by seniority they are promoted as District Judges. In Higher Judicial Service similar pattern is applied in direct recruitment of District Judges. District Judges appointed from those category are promoted by seniority as Judges of High Court. The very grass root of appointment to those post were based on caste reservation and seniority paneling of District Judges are also on caste table and their elevation in over all is also legally approved by SCs judgment by a formula of Bar - Service candidate. Now dont you see that promotion to High Court are made on the basis caste ? When the service candidates can enjoy those privileges then why not the Bar enjoy similar privilege in their elevation ?Will it not amount to violation of Article 14 and 21 of the COI ? Advocates from those category appointment have been promoted to Supreme Court and some have become the Chief Justice of India. What do you all say for this ?
