In Sec 1, ch 82. par. 1, sub section (b) The word improve means just about anything! From the discussion to the finished product, and everything in between. Including but not limited to, every single person, consultation, piece of equipment or material can be considered part of the improvement I do mean anything, Upon reading this section, I almost envision, standing on my property, discussing things I might want to do, watching my considered contractor pick his teeth with a tooth pick while talking it over. Then, tossing that used toothpick on the ground, which now is considered hazardous waste and has to be removed, Which in turn improves my property. I, being the homeowner, by allowing him to do this implied (sub sec a) a contract for the work to be done, with this considered contractor, thus now I am liable for the payment of same. A little ridiculous? A little far fetched? Maybe this particular rendition, but it is not that far off based upon my personal experiences. I guess all I am saying is, as wordy as the ACT is, as confusing as it is, and it is confusing, I have read it, I would bet, 15 times. The doors are all wide open on the possibilities of fraud and extortion~ for what any person claiming to be doing contracted (implied or expressed) work for a homeowner. Again, it gives all the protection and rights to the person providing the work, however gives no clear way to prove any of the claims It needs to be cleaned up, clarified, it needs to be amended.
