Joel E. Wright and Natalie M. Cain won summary judgment of dismissal of a legal malpractice claim in Sonbol v. Law Firm, et al. in King County Superior Court on Friday, September 13, 2013. Plaintiff was a former client of the defendant law firm, and alleged that the firm was negligent in handling his underlying dissolution action. Plaintiff was unhappy with the division of property in the dissolution and asserted that the firm had made errors in its conduct of the case. However, plaintiff had not sought and could not provide expert testimony to establish the standard of care. The trial court rejected plaintiff’s position that more discovery was required before he could obtain an expert, when Plaintiff had taken no action to do so for the better part of a year. The trial court ruled that without an expert, plaintiff’s case could not stand, and entered an order of dismissal with prejudice against plaintiff’s legal malpractice claim.
